Additional Information: 

An Emergency Contract #E2025-07 for the period of March 31, 2025 through June 30, 2025 was awarded in an amount not to exceed $525,100.00 for the Department of Public Safety.

 

An extension was adopted on August 06, 2025 for the period of July 01, 2025 through September 30, 2025 to rectify the original resolution to extend the duration of the contract with no further or additional changes required.

 

This extension of Emergency Contract #E2025-07 corrects the prior resolution to extend the contract and will be in effect until October 01, 2025 for an additional (90) days, through December 31, 2025.

                      WHEREAS, on March 31, 2025, the Department of Public Safety requested a declaration of emergency for immediate reconstruction of the floor bays that house fire apparatus Engine 5, located at 65 Congress Street, which among other issues, has been the subject of PEOSH violations, due to signs of deteriorated concrete and holes, cracks on structural columns and beams supporting the bay floors in which the renovations will allow the Fire Division to enhance firefighting operational readiness; and

 

                     WHEREAS, on April 1, 2025, the Interim Purchasing Agent declared an emergency for the reconstruction of the floor bays that house fire apparatus Engine 5 resulting in a contract in the amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) with Power Concrete Co., Inc. 497 Raymond Boulevard Newark, NJ 07105 (“contractor”); and

 

WHEREAS, on August 06, 2025, the Newark Municipal Council adopted Resolution 7R1-y for Emergency Contract #E2025-07 to continue extension for an additional (90) days starting from July 01, 2025 with no further changes for a contract total not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) and

 

WHEREAS, said Emergency Contract #E2025-07 will be revised to continue extension for an additional (90) days starting from October 01, 2025 through December 31, 2025 with no further changes for a contract total not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) and

 

                     WHEREAS, N.J.S.A. 40A:11-6 permits the award of contracts without public advertising for bids where an emergency affecting the public health, safety, or welfare requires immediate delivery of goods or performance of services; and

 

                     WHEREAS, the Department of Public Safety desires to ratify and authorize an extension of Emergency Contract #E2025-07 for the period commencing from March 31, 2025 through June 30, 2025, for a total not-to-exceed contract amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00); and

 

                     WHEREAS, N.J.A.C. 5:34-6.1(a)(3) further provides that the emergency purchasing procedure may be used when an unforeseen condition requires immediate services such as the need for immediate reconstruction or repair, to protect the public health, safety, or welfare; and

 

                     WHEREAS, it is a matter of public health, safety and welfare that Emergency Contract #E2025-07 be extended because the City of Newark still needs to ensure the Fire Division to respond quickly as rapidly growing fire can become more difficult to control, increased risk of property damage, injuries, and even loss of life with each passing minute and further delay may pose an imminent harm to the health, safety and welfare of the residential population throughout the City; and

 

                     WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b) and (c) limits the period of emergency contracts to ninety (90) days and precludes extensions of emergency contracts without authorization by the Municipal Council by Resolution; and

 

                     WHEREAS, the Department of Public Safety now seeks ratification and authorization by the Municipal Council of Emergency Contract #E2025-07 to prevent interruption of, and to continue the reconstruction of the floor bays that house fire apparatus Engine 5 by extending the emergency contract through December 31, 2025.

 

   NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent, QPA, are hereby authorized to execute an extension of Emergency Contract #E2025-07 for reconstruction of the floor bays that house fire apparatus Engine 5 with Power Concrete Co., Inc. 497 Raymond Boulevard Newark NJ, 07105, with the not-to-exceed contract amount of Five Hundred Twenty Five Thousand One Hundred Dollars and Zero Cents ($525,100.00).

 

2.                     On August 06, 2025 the Newark Municipal Council adopted Resolution 7R1-y to extend contract for an additional Ninety (90) Days. The extension of Emergency Contract #E2025-07 is ratified from July 1, 2025 through September 30, 2025.

 

3.                     The extension of Emergency Contract #E2025-07 is ratified from October 01, 2025 through the date of adoption of this authorizing Resolution. The termination date of Emergency Contract #E2025-07 is extended through December 31, 2025.

 

4.                     Funds are available for Emergency Contract #E2025-07 in an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) under line appropriation of the Official Budget, which shall be charged is:

(i)                     Fund: NW051-G25-F25D0-72090-B2025

 

5.                     The Qualified Purchasing Agent for the City of Newark shall file copies of all documents related to Emergency Contract #E2025-07 with the Office of the City Clerk. Pursuant to 2:5-13.2 of the City Code, the Purchasing Agent shall post the emergency contract on the City’s website within forty-eight (48) hours.

 

6.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This Resolution ratifies and authorizes the Mayor, and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to extend Emergency Contract #E2025-07 with Power Concrete Co., Inc. 497 Raymond Boulevard Newark NJ, 07105, from October 1, 2025 through December 31, 2025 for the contract amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00).
