WHEREAS, the City of Newark (the “City”), as a member of the New Jersey Combined Sewer Overflow (NJ CSO) Group led by the Passaic Valley Sewerage Commissioners (PVSC), will abide by the Cooperative Pricing System Agreement, which was filed with the State of New Jersey, Department of Community Affairs, Division of Local Government Services.  The current Cooperative Pricing System Agreement for the Baseline Compliance Monitoring Program and Receiving Water Quality Model development expires on December 15, 2021; and

 

WHEREAS, as a member of the NJ CSO Group, the City was included in the NJ CSO Group CSO Notification System website (<https://njcso.hdrgateway.com>).  The website and the data from it are utilized for permit required reporting and the preparation and submittal of monthly discharge reports (DMRs); and

 

WHEREAS, the website is in need of updating and maintenance due to changes in sewer system models resulting from the preparation of member’s Long-Term Control Plans; and

 

WHEREAS, the City’s Department of Water and Sewer Utilities wishes to enter into a new Cooperative Pricing System Agreement with PVSC, 600 Wilson Avenue, Newark New Jersey 07105, Manager of the NJ CSO Group, in connection with the NJ CSO Group’s System for Public Notification of Combined Sewer Overflows (CSO) and CSO DMRs-CSO Alert System Update which is required to comply with the City’s Combined Sewer Management Permit. This Agreement will allow the City to achieve the requirements set forth by the New Jersey Department of Environmental Protection and United States Environmental Protection Agency in a more cost-effective manner; and

 

WHEREAS, the City of Newark’s proportionate cost share for participation in the system update is 11.47% and will not exceed Eighteen Thousand, Four Hundred Ninety-Four Dollars and Eight Cents ($18,494.08); and

 

NOW, THEREFORE, BE IT RESOLVED BY THE MNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of Water and Sewer Utilities, is authorized and directed to execute the new Cooperative Pricing System Agreement with PVSC, Manager of the NJ CSO Group, in connection with the NJ CSO Group’s System for Public Notification of Combined Sewer Overflows (CSO) and CSO DMRs-CSO Alert System Update which is required to comply with the City’s Combined Sewer Management Permit. 

 

2.                     Attached hereto is a Certification of Funds from the Director of the Department of Finance, which states that funds in the amount of (Eighteen Thousand, Four Hundred Ninety-Four Dollars and Eight Cents ($18,494.08) are available in the 2021 Budget under Business Unit: NW038, Department ID: 800, Division/Project: 8003, Account: 71770.  The Director of the Department of Water and Sewer Utilities shall file a copy of the Certification of Funds along with the original Resolution and the executed Contract in the Office of the City Clerk.

 

3.                     There shall be no amendment or change to the contract without approval by the Municipal Council.

 

4.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

5.                     A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities.

6.                     If required by State Law, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute the new Cooperative Pricing System Agreement with PVSC, Manager of the NJ CSO Group, in connection with NJ CSO Group’s System for Public Notification of Combined Sewer Overflows (CSO) and CSO DMRs-CSO Alert System Update which is required to comply with the City’s Combined Sewer Management Permit, for a total amount not to exceed $18,494.08, for a period of ninety (90) days from date of adoption by the Municipal Council.
