ORDINANCE TO TRANSFER EIGHT (8) PROPERTIES IN THE WEST WARD OWNED BY THE CITY OF NEWARK TO THE COUNTY OF ESSEX FOR THE DEVELOPMENT OF OPEN SPACE AND PARKING AROUND THE NEW ESSEX COUNTY VOCATIONAL TECHNICAL SCHOOL CAMPUS IN ACCORDANCE WITH LOCAL LANDS AND BUILDINGS LAW, FOR THE TOTAL SUM OF ONE DOLLAR ($1.00).
41 SOUTH 11TH STREET, 43 SOUTH 11TH STREET, 45 SOUTH 11TH STREET AND 47 SOUTH 11TH STREET; BLOCK 1868, LOTS 9.01, 9.02, 9.03 AND 9.04: 525-533 W. MARKET STREET, 535-537 W. MARKET STREET AND 541-545 W. MARKET STREET; BLOCK 1891.01, LOTS 34, 36 AND 56: 4-6 MYRTLE AVENUE; BLOCK 1891.01, LOT 30.

WHEREAS, the Essex County Vocational Technical School District (the “School District”) has acquired the former United Hospital property along West Market Street for the purpose of developing an Essex County Vocational School Campus (the “School Campus”); and
WHEREAS, to assist the School District in acquiring properties for additional open space and parking at the School Campus, the County of Essex (the “County”) plans to acquire additional properties around the perimeter of the School Campus (the “Campus Area”); and
WHEREAS, the City of Newark (the “City”) owns the following eight vacant properties around the Campus Area:

(“Properties”); and
WHEREAS, on May 19, 2015, the County requested the assistance from the City in acquiring the Properties for the School Campus project; and
WHEREAS, pursuant to Local Lands and Buildings Law, N.J.S.A. 40A:12-13.4, the City is authorized to convey property that is not needed for municipal purposes to the County, provided that the Properties are used only for public purposes, and that if the Properties are not utilized for a public purpose, title thereto shall revert back to the City without any entry or reentry made thereon on behalf of the City; and
WHEREAS, the City desires to transfer the Properties to the County for the development of the School Campus project.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. The City hereby authorizes the following parcels described by their block and lot(s) on the City’s tax maps and their address:

(“Properties”)
to be sold to the County of Essex (the “County”) for the sum of $1.00 for all of the Properties.
Section 2. The Mayor and/or his designee the, Deputy Mayor/Director of the Department of Economic and Housing Development are each hereby authorized to enter into and execute and deliver any and all documents and certificates necessary or convenient in connection with the transactions authorized herein, including, without limitation, a Purchase and Sale Agreement, Quitclaim Deed(s), affidavit(s) of title, closing statement(s) and continuing disclosure agreement(s) in substantially the form attached hereto, and the City Clerk and/or Deputy Clerk is hereby authorized to attest to any and all documents and certificates necessary or convenient in connection with the transactions authorized herein.
Section 3. In accordance with Local Lands and Buildings Law, N.J.S.A. 40A:12-13.4, the Properties are not needed for municipal purposes and the City is authorized to convey the Properties to the County for nominal consideration, provided that the Properties are used only for a public purpose, and that if the Properties are not used for a public purpose, title thereto shall revert back to the City without any entry or reentry made thereon on behalf of the City.
Section 4. The Deputy Mayor/Director of the Department of Economic and Housing Development shall place a copy of the executed Agreement and all such other executed agreements and documents authorized by this ordinance on file in the Office of the City Clerk.
Section 5. This ordinance shall take effect upon final passage and publication in accordance with the Laws of the State of New Jersey.
