This Resolution will amend Resolution 7R4-b, adopted on June 15, 2016, by increasing the grant funding from $2,703,000.00 to $5,663,005.13 ($4,656,011.57 for construction and $1,006,993.56 for construction inspection and management services).
This Resolution will also authorize the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to enter into and execute Federal Aid Cost Reimbursement Agreement #2023-DT-BLA-206 with the New Jersey Department of Transportation, Division of Local Aid and Economic Development.

WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and
WHEREAS, on June 15, 2015, the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2016-2017 solicitation of the Local Safety and High Risk Rural Roads Program; and
WHEREAS, on September 1, 2015, the City of Newark, Department of Engineering, submitted a proposal for the FY 2016-2017 Local Safety High Risk Rural Roads Program to the North Jersey Transportation Planning Authority (NJTPA), for the Ferry Street Pedestrian Safety Corridor Improvements project, requesting grant funding in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00); and
WHEREAS, as a result of this proposal, the City of Newark was notified on February 25, 2016, by NJTPA that the City had been approved for grant funding through the FY 2016-2017 Local Safety High-Risk Rural Roads Program for the Ferry Street Pedestrian Safety Corridor Improvements project, in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00); and
WHEREAS, on June 15, 2016, the Municipal Council adopted Resolution 7R4-b, which ratified and authorized the City of Newark to apply for and accept grant funds in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00) for the Ferry Street Pedestrian Safety Corridor Improvements project; and
WHEREAS, on May 23, 2023, the City of Newark submitted to NJDOT a cost proposal for the construction inspection services for the Ferry Street Pedestrian Safety Corridor Improvements project in the amount of One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56); and
WHEREAS, on July 26, 2023, the City of Newark submitted to NJDOT the plans, specifications, and engineering estimate for the Ferry Street Pedestrian Safety Corridor Improvements project in the amount of Four Million Six Hundred Fifty-Six Thousand, Eleven Dollars and Fifty-Seven Cents ($4,656,011.57); and
WHEREAS, on August 22, 2023, the Federal Highway Administration (FHWA) authorized funding in the amount of Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), Four Million Six Hundred Fifty-Six Thousand Eleven Dollars and Fifty-Seven Cents ($4,656,011.57) for construction and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56), for construction inspection and management services) for the Ferry Street Pedestrian Safety Corridor Improvements project; and
WHEREAS, the City of Newark seeks to amend Resolution 7R4-b adopted on June 15, 2016, to accept the additional grant funds for the Ferry Street Pedestrian Safety Corridor Improvements project from Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00) to Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), Four Million Six Hundred Fifty-Six Thousand Eleven Dollars and Fifty-Seven Cents ($4,656,011.57) for construction and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56) for construction inspection and management services, and to authorize the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to enter into and execute a Federal Aid Cost Reimbursement Agreement No. 2023-DT-BLA-206 with the New Jersey Department of Transportation, Division of Local Aid and Economic Development.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R4-a, adopted on June 15, 2016, is hereby amended to increase the overall project cost of the Ferry Street Pedestrian Safety Corridor Improvements from Two Million Seven Hundred and Three Thousand Dollars and Zero Cents ($2,703,000.00) to Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), Four Million Six Hundred Fifty-Six Thousand Eleven Dollars and Fifty-Seven Cents ($4,656,011.57) for construction, and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56) for construction inspection and management services, for the Ferry Street Pedestrian Safety Corridor Improvements Project, with no municipal funds required.
2. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized, on behalf of the City of Newark, to accept the grant funds from the New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT) for the Ferry Street Pedestrian Safety Corridor Improvements project in the amount of Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), with no municipal funds required (a copy of the NJDOT grant award letter is attached hereto and made a part hereof).
3. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are further hereby authorized to enter into and execute Federal Aid Cost Reimbursement Agreement No. 2023-DT-BLA-206 with the NJDOT to receive and expend the grant award in the amount of Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), for the Ferry Street Pedestrian Corridor Improvements project.
4. The Municipal Council hereby ratifies its acceptance of these grant funds from June 15, 2016 to the date of adoption of this authorizing Resolution.
5. No municipal funds are required for receipt or acceptance of this grant award.
6. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
7. The Director of the Department of Engineering shall file a fully executed copy of the grant application, grant award letter, the final authorization letter, and grant/project agreement in the Office of the City Clerk.

This Resolution ratifies and authorizes the City of Newark to amend Resolution 7R4-b adopted on June 15, 2016, to accept the additional grant funds for the Ferry Street Pedestrian Safety Corridor Improvements project from $2,703,000.00 to $5,663,005.13, ($4,656,011.57 for construction and $1,006,993.56 for construction inspection and management services), and further authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to enter into and execute Federal Aid Cost Reimbursement Agreement No. 2023-DT-BLA-206 with New Jersey Department of Transportation, Division of Local Aid and Economic Development, with no municipal funds required.
