WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2024 Municipal Aid Program (the "NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and

WHEREAS, the City of Newark (the "City") needs to improve the following various roads that include drainage, ADA ramps, resurfacing, decorative crosswalks and pavement markings throughout the City; and

WHEREAS, the City desires to further the public interest by obtaining funding from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets 2024 Newark, MA-24 Project within the City as set forth in detail in the list below; and

WHEREAS, on June 25, 2023, on behalf of the City, the Acting Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of Four Million Three Hundred Two Thousand Nine Hundred Seventy-Eight Dollars and Zero Cents ($4,302,978.00) from the NJDOT Municipal Aid Program for Street Resurfacing within the City, identified as application MA-2024 - Various Streets 2024 for the City of Newark with no City funds required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a Resolution from the Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering desires to accept the grant award and execute a Grant Agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application MA-2024 - Various Streets 2024 for the City, the Acting Director of the Department of Engineering shall submit a copy of the Grant Agreement to the City Clerk, Corporation Counsel and the Business Administrator.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:


1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to submit an electronic grant application identified as MA-2024 - Various Streets 2024 on behalf of the City of Newark to the New Jersey Department of Transportation requesting grant funding in the amount of Four Million Three Hundred Two Thousand Nine Hundred Seventy-Eight Dollars and Zero Cents ($4,302,978.00) from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets 2024 Newark, MA-24 (a copy of the application is attached hereto and made a part hereof), with no City funds required.

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.

4. Upon notification of the receipt of a grant award in connection with this application, the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT to receive and expend the grant award from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets 2024 Newark, MA-24.

5. Upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering shall submit a complete copy of the Grant Agreement and any associated documents to the City Clerk, Corporation Counsel and the Business Administrator for review, approval, and signature.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.


STATEMENT

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application, accept grant funding, and enter into and execute an agreement for grant funding in the amount of $4,302,978.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets 2024 Newark, MA-24. No municipal funds are required.
