Additional Information: 

This State Contract will provide LED Signal Indications and Warning Devices for the City of Newark, Department of Engineering, Division of Traffic and Signals

 WHEREAS, N.J.S.A. 40A:11-12 authorizes local contracting units to acquire goods or services without advertising for bids when they are purchased from an authorized State contract approved by the Department of the Treasury, Division of Purchase and Property; and

WHEREAS, the Purchasing Agent of the City does not object to the formal request from the Department of Engineering to utilize the authorized vendors/distributors below for the purchase of LED Signal Indication and Warning Devices for the City’s Department of Engineering, Division of Traffic and Signals. These vendors are members of State Contract(s) #T1956 and NJDOT #24-FOOD-71856, 24-FOOD-71857 and 24-FOOD-71858, as identified below:

 

1)                     Contract Number 24-FOOD-71858: Signal Control Products, 199 Evans Way, Branchburg, NJ 08876-4600

2)                     Contract Number 24-FOOD-71857:  Intelligent Traffic Supply Products LLC, 3005 Hadley Road, Suite 5, South Plainfield, NJ 07080,

3)                     Contract Number 24-FOOD-71856: General Highway Products Inc., PO Box 596, 878 Sussex Blvd., Broomall, PA 19008

 

WHEREAS, N.J.A.C. 5:34-7.29 mandates that the terms and conditions of said purchases, including pricing and payment, be binding on the local contracting unit and the vendor, and that the identifier NJCP-1 be used by all contracting units purchasing under the Division of Purchase and Property's Cooperative Purchasing Program; and

WHEREAS, funding source for this purchase is under the Department of Engineering, Division of Traffic and Signals account code NW011-110-1107-83750-B2025.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     Pursuant to N.J.S.A. 40:12 and N.J.A.C. 5:34-7.29, the Mayor and/or his designees, the Business Administrator or the Purchasing Agent, are hereby authorized to utilize State Contracts T1956 LED Signal Indications and Warning Devices, NJDOT #24-FOOD-71856, 24-FOOD-71857 and 24-FOOD-71858 to permit agreements with the vendors/distributors listed below for the provision of Signal Indications and Warning Devices to the City’s Department of Engineering, Division of Traffic and Signals:

a)                     Contract 24-FOOD-71858; Signal Control Products, 199 Evans Way, Branchburg, NJ 08876-4600

b)                     Contract 24-FOOD-17857; Intelligent Traffic Supply Products LLC, 3005 Hadley Road, Suite 5, South Plainfield, NJ 07080,

c)                     Contract 24-FOOD-71856; General Highway Products Inc., PO Box 596, 878 Sussex Blvd., Broomall, PA 19008

 

2.                     Authorization provided by this Resolution shall be for the period commencing upon Council approval through April 14, 2027, inclusive of any extensions by the State.

 

3.                     The terms and conditions of all purchases hereunder shall be in accord with the relevant State Contract, New Jersey Standard Terms and Conditions, Method of Operation and Third Party Agreement, if applicable.

 

4.                     This contract shall not exceed One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00) yearly. It is being awarded as an open-ended contract pursuant to N.J.A.C. 5:30-5.5(d)(2).  A Certification of the Availability of Funds shall be executed each time a purchase order is placed and charged against the following Funding Source: NW011-110-1107-83750-B2025.

 

5.                     There shall be no amendments to this Resolution without the approval of the Municipal Council.

 

6.                     There shall be no advance payment of this State Contract in accordance with N.J.S.A. 40A:5-16.

 

7.                     This contract complies with N.J.S.A. 19:44A-20.5 and the City of Newark’s Pay-to-Play ordinance and, as a purchase pursuant to a state contract award, constitutes a fair and open procedure.

 

8.                     The Division of Central Purchasing shall file a duly executed copy of the contract in the Office of the City Clerk.

 

STATEMENT

 

This Resolution authorizes the Mayor and/or his designees, the Business Administrator or the Purchasing Agent to utilize State Contracts T1956 -LED Signal Indications and Warning Devices-, NJDOT #24-FOOD-71856, 24-FOOD-71857 and 24-FOOD-71858 to permit agreements with the three (3) vendors/distributors of said contracts as listed herein, for the provision of Signal Indications and Warning Devices to the City’s Department of Engineering, Division of Traffic and Signals, in an amount not to exceed One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00) yearly for the period commencing upon approval by the Municipal Council, through April 14, 2027, inclusive of any extensions by the State
