WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $1,667,000.00 for the Ryan White HIV/AIDS - Ending the HIV Epidemic Program, and no adequate provision has been made in the 2021 Temporary Budget for the aforesaid purpose, and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the same; and
WHEREAS, by the award letters dated January 21, 2021 and March 2, 2021, the United States Department of Health and Human Services, Health Resources and Services Administration (HRSA) has awarded the City of Newark the Ryan White HIV/AIDS - Ending the HIV Epidemic Grant in the amounts of $240,000.00 and $1,427,000.00 for a total grant award of $1,667,000.00. The aforementioned program will provide Ryan White health, social and related services for HIV/AIDS-infected individuals and families residing in the Newark Eligible Metropolitan area (EMA); and
WHEREAS, a previous resolution authorizing TE # 24 and prior emergency appropriations submitted for Municipal Council approval totaled $155,964,794.36; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2021 pursuant to N.J.S.A. 40A:4-20, including this resolution, total................$157,631,794.36.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is hereby made for the following classification:

Ending the Epidemic Program
2. Said emergency appropriation shall be provided for in the 2021 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This legislation authorizes and establishes the temporary emergency appropriation for the Ryan White HIV/AIDS - Ending the HIV Epidemic Program in the amount of $1,667,000.00. The United States Department of the Health and Human Services, Health Resources and Services Administration (HRSA) has awarded the City of Newark, Ryan White HIV/AIDS for Ending the HIV Epidemic Grant. The project period is March 1, 2021 through February 28, 2022.
