WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities FY2020 Municipal Aid Program (“NJDOT Municipal Aid Program”) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on July 11, 2019, the Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2020 - Newark (25 locations, MA-25) within the City of Newark, identified as application MA-2020-VARIOUS STREETS-2020 (25 LOCATIONS) - 00688 for City of Newark with no City funds required; and
WHEREAS, on August 20, 2019, the Municipal Council adopted Resolution 7R3-a(S) ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for Contract #2020-02 Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20, NJDOT; and
WHEREAS, on November 21, 2019, NJDOT announced that the City was selected to receive a grant award in the amount of $2,910,884.00 for the construction of Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20; and
WHEREAS, NJDOT requires the City to award the contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20 within two (2) years of the announcement of the receipt of a grant award; and
WHEREAS, due to the required environmental screening under the Executive Order 215 (EO-215) by the Bureau of Environmental Program Resources and the required compliance screening for the New Jersey State Historic Preservation Office (SHPO) and NJDOT Bureau of Structural and Railroad Engineering Services, the award has been delayed; and
WHEREAS, the City of Newark wishes to request that the NJDOT allow the City of Newark to award the contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20 by May 21, 2022.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee the Director of the Department of Engineering is hereby ratified and authorized to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20 by May 21, 2022.
2. All other terms and conditions of the grant award from the NJDOT for Contract #2020-02 Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20 project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2020 - Newark (25 Locations) MA-20 by May 21, 2022. No municipal funds are required.
