Additional Information:
This Resolution authorizes Change Order #2 to Contract 2022-02PS, for Licensed Site Remediation Professional (LSRP) services required to address public safety concerns and ensure compliance with NJDEP remediation standards. This change order increases the contract by $86,670.00, resulting in a new total contract amount not to exceed $173,770.00. An additional twelve (12) months is added to the contract term to permit the completion of the LSRP-related work.

WHEREAS, the Municipal Council thereafter approved Change Order #1 for additional soil sampling and testing, increasing the contract amount by $31,200.00, for a revised total of $87,100.00; and
WHEREAS, during the design process, samples were taken from the Project site to obtain the proper waste disposal classification of the soil, which revealed that the soil contained elevated levels of benzo(a)pyrene and lead. As a result, additional soil samples and testing are required, which will cost approximately Thirty-One Thousand Two Hundred Dollars and Zero Cents ($31,200.00); and
WHEREAS, Suburban Consulting Engineers, Inc., submitted a proposal for these additional LSRP services in the amount of $86,670.00; and
WHEREAS, the Acting Director of the Department of Engineering now seeks to enter into and execute Change Order #2 to Contract 2022‑02PS to increase the contract by $86,670.00, for a new total not to exceed $173,770.00, and to extend the contract period by an additional twelve (12) months; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes Change Order #2 to Contract 2022‑02PS with Suburban Consulting Engineers, Inc., increasing the contract by $86,670.00 for a new total amount not to exceed $173,770.00.
2. Pursuant to N.J.S.A. 40A:11-15(9), the Municipal Council authorizes an twelve (12) month extension of the term of Contract 2022‑02PS to permit the completion of LSRP‑related tasks.
3. No further changes to this Contract may be made without prior Municipal Council approval.
4. Attached is the Comptroller’s Certification confirming sufficient funds in the amount of $86,670.00 in the following Account: NW026-32720-B2023.
5. There shall be no amendments or changes to this change order contract without prior approval of the Municipal Council, and there shall be no advance payments made against the contract in accordance with N.J.S.A. 40A:5-16.
6. A copy of the executed agreement herein authorized shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering and shall be made available for public inspection.
