WHEREAS, on January 23, 2025, pursuant to N.J.S.A. 40A:11-4.1 et seq., the City of Newark (the “City”) through its Qualified Purchasing Agent (the “QPA”), advertised to solicit a Request for Proposals (“RFP”) for contractors to provide Senior Nutrition Food Program, for the Department of Recreation, Cultural Affairs and Senior Services, as described in the attached RFP proposal; and
WHEREAS, N.J.S.A. 40A:11-4.1(1)(g) provides for the use of competitive contracting for contracted food services; and
WHEREAS, the Division of Central Purchasing published the Bid packages on the City’s procurement portal to provide broader access and download capability to potential bidders; and
WHEREAS, on February 6, 2025, the Division of Central Purchasing received five (5) proposals in response to this advertisement; and
WHEREAS, the Director of the Department of Recreation, Cultural Affairs and Senior Services recommended that a multiple award be made to: Kings Family Restaurant & Catering, 557 Clinton Avenue, Newark, NJ 07108; Tossed NJ Corp, 89 Mulberry Street, Newark, NJ 07102; Brooklyn Kitchen, 2780 Stillwell Avenue, Brooklyn NY 11224 and Chrill Care, 201 Bloomfield Avenue, Verona NJ 07044 asthe lowest, responsive and responsible bidders; and
WHEREAS, the Purchasing Agent, QPA, concurs with the recommendation from the Director of the Department of Recreation, Cultural Affairs and Senior Services that a multiple award be made to the following four (4) sub-recipients: Kings Family Restaurant & Catering, 557 Clinton Avenue, Newark, NJ 07108; Tossed NJ Corp, 89 Mulberry Street, Newark, NJ 07102; Brooklyn Kitchen, 2780 Stillwell Avenue, Brooklyn NY 11224 and Chrill Care, 201 Bloomfield Avenue, Verona NJ 07044; the lowest, responsive and responsible bidder; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the recommended bidder consented to holding the bid for consideration until such time as an award is made, as the law permits; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the Fair and Open Process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent (the “QPA”), are hereby authorized to enter into and execute a contract with Kings Family Restaurant & Catering, 557 Clinton Avenue, Newark, NJ 07108; Tossed NJ Corp, 89 Mulberry Street, Newark, NJ 07102; Brooklyn Kitchen, 2780 Stillwell Avenue, Brooklyn NY 11224 and Chrill Care, 201 Bloomfield Avenue, Verona NJ 07044,102, to provide Senior Nutrition Food, whose proposal was received on the advertised due date and determined to be the lowest responsive and responsible respondent in accordance with the proposal specifications.
2. The term of the contract will be established upon approval of Municipal Council for twelve (12) consecutive months for multiple vendors, pursuant to N.J.S.A. 40A:11-15, with a start date to commence upon Municipal Council approval.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2023 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2).
5. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: Department of Recreation, Cultural Affairs and Senior Services NW011-160-1609-83210, covering the amount of an order. This contract shall not exceed Six Hundred Thirty Thousand Dollars and Zero Cents ($630,000.00) for a period to be established and not to exceed twelve (12) consecutive months for multiple vendors.
6. The QPA shall file a copy of this resolution and the duly executed copy of the contract in the Office of the City Clerk.
7. Attached hereto is a Certification of Funds from the Municipal Comptroller of the City of Newark, which states that there are sufficient funds for the purpose set forth hereinabove. NW051; Dept. ID G25; Project M25S0; Activity A; Account# 72030; Budget Ref. B2025; NW051-G21-2H21U-72030-B2021, $8,000;
7. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Qualified Purchasing Agent, to enter into and execute contracts with: Kings Family Restaurant & Catering, 557 Clinton Avenue, Newark, NJ 07108; Tossed NJ Corp, 89 Mulberry Street, Newark, NJ 07102; Brooklyn Kitchen, 2780 Stillwell Avenue, Brooklyn NY 11224 and Chrill Care, 201 Bloomfield Avenue, Verona NJ 07044, to provide Senior Nutrition Food to the City’s Department of Recreation, Cultural Affairs and Senior Services, at a contract amount not to exceed Six Hundred Thirty Thousand Dollars and Zero Cents ($630,000.00) for a period to be established upon Municipal Council approval and not exceed twelve (12) consecutive months for multiple vendors with the start date commencing upon Municipal Council approval.
