WHEREAS, on June 15, 2005, the City of Newark ("City") utilized the powers of Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., to designate the entire City of Newark as an area in need of rehabilitation; and
WHEREAS, on August 7, 2013, the Municipal Council of the City of Newark adopted Ordinance 6PSF-I, approving the Newark's River: Public Access and Redevelopment Plan (the "Original Plan") along the Passaic River, which has been amended from time to time; and
WHEREAS, on February 28, 2018, the City of Newark, Department of Economic and Housing Development (the “Department”) advertised for bids for the Riverfront Park Expansion - Phase C Project along the Passaic River; and
WHEREAS, on April 6, 2018, the Department received four (4) bids for the Riverfront Park Expansion - Phase C Project; and
WHEREAS, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., the Department desires to accept the bid proposal submitted by the lowest responsible bidder, Tomco Construction, Inc., 22 Howard Boulevard, Suite 204, Mt. Arlington, New Jersey 07856, and execute a contract for the Riverfront Park Expansion - Phase C Project for an amount not to exceed $8,154,999.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or the Director of the Department of Economic and Housing Development of the City are hereby authorized to accept the bid proposal submitted by the lowest responsible bidder, Tomco Construction, Inc., 22 Howard Boulevard, Suite 204, Mt. Arlington, New Jersey 07856, and to execute a contract for the Riverfront Park Expansion - Phase C Project, for an amount not to exceed $8,154,999.00.
2. Attached hereto are the Certifications of Funds issued by the Director of Finance of the City of Newark, which states that: (1) there are available sufficient legally appropriated funds in the amount of $8,154,999.00 for the purpose set forth hereinabove, and; (2) the line appropriation of the official budget, which shall be charged is as follows: Business Unit NW045, Dept. 16G, Div./Proj. 16C00, Account# 94710 Budget Ref: B2016.
3. The Director of the Department of Economic and Housing Development shall file a fully executed copy of the contract and the Certifications of Funds in the Office of the City Clerk.
4. The public bidding process complies with the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
5. This resolution shall take effect immediately.
STATEMENT
This Resolution authorizes the Mayor and/or his designee, the Director of the Department of Economic and Housing Development, to accept the bid proposal submitted by the lowest responsible bidder, Tomco Construction, Inc., 22 Howard Boulevard, Suite 204, Mt. Arlington, New Jersey 07856, and to execute a contract for the Riverfront Park Expansion - Phase C Project for an amount not to exceed $8,154,999.00.
