Additional Information: 

This resolution simultaneously authorizes two extensions of the emergency contract period for Emergency Contract #E2026-09. The initial period was January 25, 2026 through April 25, 2026, and contracts were awarded to the following seven (7) vendors: Hazmat Diagnostic LLC 16 Glenwild Avenue, Bloomingdale, NJ 07403, Atlas Desk, Office Furniture & Services 191 Central Avenue 2nd Fl, Newark, NJ 07103, Joseph Environmental, LLC 80 Varsity Road, Newark, NJ 07106, DIA General Construction, Inc 1360 Clifton Avenue CPMB Suite 218, Clifton, NJ 07012, Glenwood Office Furniture 561 Route 22 West, Hillside, NJ 07205, Defaria Flooring, 629 Broadway, Long Branch, NJ 07740, Preferred Local Government Consulting, LLC 12 Birch Avenue, Caldwell, NJ 07006. Additionally, in-house stock ceiling tiles and paint were supplied by various City suppliers for the Department of Public Works.

 

This Resolution combines a first and second request for an extension of the emergency contract period, effectively extending it for one hundred eighty (180) days through October 24, 2026. It also increases the initial not-to-exceed contract amount by Fifty Thousand Dollars and Zero Cents ($50,000.00), raising it from Four Hundred Twenty-Five Thousand Dollars and Zero Cents ($425,000.00) to Four Hundred Seventy-Five Thousand Dollars and Zero Cents ($475,000.00).

WHEREAS, on January 25, 2026, a supply line in a water closet located within the Municipal Council Office burst, allowing water to migrate through pipe chases and other penetrations down two floors to the basement level resulting in significant water damages to offices throughout three floors on the west side of the City Hall; and

 

WHEREAS, on April 13, 2026, the Director of the Department of Public Works (“Department”) requested a declaration of emergency for the immediate cleaning and restoration services to multiple offices located at the City Hall of Newark due to flooding damages caused by pipe burst late January 2026. If left unattended may result in the growth of mildew and mold, creating a potentially unsafe and hazardous conditions to city residents. A report prepared by Preferred Local Government Consulting, LLC, detailing the extent of the damages, response, activities, and contractor involvement determining the flooding has resulted in significant damages requiring immediate emergency response, including but not limited to: demolition of impacted office spaces, environmental abatement and remediation, dehumidification and moisture control, removal and restoration of damaged materials, including documents and furnishings, and replacement of building materials such as flooring, ceilings, and sheetrock; and

 

WHEREAS, therefore, on April 13, 2026, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1 et seq., the Qualified Purchasing Agent, QPA, declared an emergency and authorized Emergency Contract # E2026-09 with seven (7) city vendors Hazmat Diagnostic LLC 16 Glenwild Avenue, Bloomingdale, NJ 07403, Atlas Desk, Office Furniture & Services 191 Central Avenue 2nd Fl, Newark, NJ 07103, Joseph Environmental, LLC 80 Varsity Road, Newark, NJ 07106, DIA General Construction, Inc 1360 Clifton Avenue CPMB Suite 218, Clifton, NJ 07012, Glenwood Office Furniture 561 Route 22 West, Hillside, NJ 07205, Defaria Flooring, 629 Broadway, Long Branch, NJ 07740, Preferred Local Government Consulting, LLC 12 Birch Avenue, Caldwell, NJ 07006 and Various City Suppliers, for a not-to-exceed contract amount of Four Hundred Twenty-Five Thousand Dollars and Zero Cents ($425,000.00); and

 

WHEREAS, the repairs are still ongoing, with floors in the Municipal Council’s suite requiring removal and replacement due to warping and other significant damages. An additional Fifty Thousand Dollars and Zero Cents ($50,000.00) is needed to cover for the repair and replacement of the flooring and costs to breakdown and re-assemble office furniture in that area, in which these repairs will be performed and overseen by Glenwood Office Furniture; and

 

WHEREAS, on June 26, 2026, the Department of Public Works Director requested an extension and increase in the Not to Exceed amount of emergency contract #E2026-09 for the continued cleaning and restoration services to multiple offices located at the City Hall of Newark due to flooding damages caused by pipe burst late January 2026. Two ninety (90)-day term extensions are required and so this resolution combines the first and second request for an extension, effectively extending emergency contract #E2026-09 for one hundred eighty (180) days through October 24, 2026. In addition, the current contract amount of Four Hundred Twenty-Five Thousand Dollars and Zero Cents ($425,000.00) will be increased by Fifty Thousand Dollars and Zero Cents ($50,000), for an updated Not to Exceed Amount of Four Hundred Seventy-Five Thousand Dollars and Zero Cents ($475,000.00). All other terms and conditions remain the same; and 

 

WHEREAS, the Qualified Purchasing Agent is satisfied that the emergency continues to exist, notwithstanding the good faith efforts of the Department; and

 

WHEREAS, City Ordinance 6PSF-e adopted April 6, 2011 limits the period of emergency contracts to ninety (90) days and permits extensions only with the authorization of the Municipal Council.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

The Municipal Council hereby authorizes a one-hundred-eighty-day (180-day) extension of Emergency Contract # E2026-09, which represents two (2) ninety-day (90-day) extensions of said contract from April 26, 2026 through July 25, 2026 and July 26, 2026 through October 23, 2026.

 

The not-to-exceed contract amount of Emergency Contract #E2026-09 is hereby increased by Fifty Thousand Dollars and Zero Cents ($50,000), for an updated not-to-exceed amount of Four Hundred Seventy-Five Thousand Dollars and Zero Cents ($475,000.00).

 

This extension of the emergency contract and the increase in the emergency contract amount are ratified back to April 26, 2026 through the date of adoption of this authorizing resolution.

 

Funds for the emergency contract shall be drawn from budget account code: NW011-060-0604-71710 B2026, Claim Filed with City’s Insurance Carrier.

 

The Purchasing Agent shall file a copy of Emergency Contract #E2026-09 and any and all documents amending same in the Office of the City Clerk and shall post a copy of the emergency contract and any extension thereof on the City of Newark’s website within forty-eight (48) hours.

 

If required by State Law, the City Clerk shall provide the appropriate notice of the award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.

The extension is through April 26, 2026 to October 24, 2026, for an increased total not-to-exceed amount of Four Hundred Seventy-Five Thousand Dollars and Zero Cents ($475,000.00) upon the adoption of this resolution.
