WHEREAS, the State of New Jersey Department of Transportation (NJDOT) State Aid to Counties and Municipalities FY2013 Municipal Aid Program (NJDOT Municipal Aid Program) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on September 17, 2012, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $1,875,000.00 from the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark, identified as application MA-2013-Newark City-00238, with no municipal funds required; and
WHEREAS, pursuant to Resolution 7R4-f, adopted January 16, 2013, the City of Newark ratified and authorized the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the New Jersey Department of Transportation (NJDOT) for the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark; and
WHEREAS, the City of Newark received notice on May 1, 2013 (a copy of the NJDOT executed Agreement approval letter is attached hereto and made a part hereof) that it had been awarded a grant in the amount of $1,326,370.00 from the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark, with no City funds required; and
WHEREAS, the Department of Engineering seeks to amend Resolution 7R4-f, adopted January 16, 2013, to amend the dollar amount of the grant award accepted, and authority to execute an agreement with and accept grant funds in the amount of $1,326,370.00 from the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to accept the grant award in the amount of $1,326,370.00 from the New Jersey Department of Transportation(a copy of the NJDOT grant award approval letter is attached hereto and made a part hereof).

- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amended amount of $1,326,370.00 from the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark.
- Resolution 7R4-f, adopted January 16, 2013 is hereby amended to change the amount of the grant acceptance authorized from $1,875,000.00 to $1,326,370.00.

- No municipal funds are required for receipt or acceptance of this grant award.

- The Director of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.
STATEMENT
This resolution amends Resolution 7R4-f, adopted January 16, 2013, and ratifies and authorizes the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the NJDOT Municipal Aid Program for Improvements to Various Streets - 2013 Newark Project (10 Locations - MA-2013) within the City of Newark, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amended amount from $1,875,000.00 to $1,326,370.00. No municipal funds are required for receipt or acceptance of this grant award.
