WHEREAS, the City of Newark’s (“City”), Department of Health and Community Wellness (“DHCW”), has expended and continues to expend funds to provide Local Health Department (“LHD”) expenses directly related to the COVID-19 pandemic and to Sustain Public Health Infrastructure; and
WHEREAS, the New Jersey Association of County and City Health Officials (“NJACCHO”) P.O. Box 6987, Freehold, New Jersey 07728, has made funds available for LHD to Sustain Public Health Infrastructure; and
WHEREAS, on or about June 13, 2024, on behalf of the City, the Director of the Department of Health and Community Wellness, electronically filed an application to the NJACCHO, requesting grant funding for the aforementioned purpose, which includes the City (a copy of the application is attached hereto and made a part hereof); and
WHEREAS, as a result of this application, the City was awarded a grant in the amount of One Hundred Sixty-Eight Thousand Forty-Nine Dollars and Zero Cents ($168,049.00) for the period of July 1, 2024 through March 31, 2026 (a copy of the Letter of Agreement is attached hereto and made a part hereof); and
WHEREAS, the Director of the Department of Health and Community Wellness did subsequently, on behalf of the City, cause the appropriate electronic submission to be made necessary to accept the above-mentioned grant award; and
WHEREAS, the City recognizes that the NJACCHO, may extend the time of the grant award and/or provide additional funds if made available; and
WHEREAS, the NJACCHO may amend the grant to reflect the grant time extension and/or increase or decrease of additional funds if made available; and
WHEREAS, the City’s Department of Health and Community Wellness shall upon any such extension of time of the grant and or increase or decrease of additional funds, file an amending resolution reflecting the final term and award amount of the grant; and
WHEREAS, terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Municipal Council by resolution.
WHEREAS, NJACCHO agrees to work closely with the DHCW and the New Jersey Department of Health (“NJDOH”) to resolve any payment discrepancies, should they arise, in a timely manner; and
WHEREAS, the DHCW accepts funds from NJACCHO as reimbursement for LHD COVID-19 related expenditures and to Sustain Public Health Infrastructure to better prepare and respond to emerging infectious diseases, at no cost to the City; and
WHEREAS, as a condition of reimbursement the DHCW agrees to any modifications to this reimbursement program as may be imposed upon NJAACHO, NJDOH; and
WHEREAS, the DHCW shall adhere to NJACCHO deadlines for reimbursement submission(s).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to enter into an agreement and accept grant funds for COVID-19 related expenses and to Sustain Public Health Infrastructure to better prepare and respond to emerging infectious diseases from the New Jersey Association of County and City Health Officials (NJACCHO), whose principal place of business is P.O. Box 6987, Freehold, New Jersey 07728, for the period commencing July 1, 2024 through March 31, 2026 (“Letter of Agreement”) (a copy of the Letter of Agreement is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies the Letter of Agreement from June 26, 2024 to the date of the adoption of this authorizing Resolution.
3. The Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept the grant amount of One Hundred Sixty-Eight Thousand Forty-Nine Dollars and Zero Cents ($168,049.00) from NJACCHO.
4. Acceptance of reimbursement funds does not require the expenditure of any municipal funds.
5. The Director of the Department of Health and Community Wellness shall file with the Office of the City Clerk a fully executed copy of the Agreement with NACCHO.
STATEMENT
This resolution ratifies and authorizes the Mayor, and/or his designee, the Director of the Department of Health and Community Wellness, to execute a Letter of Agreement and accept reimbursement funds from the New Jersey Association of County and City Health Officials (NJACCHO), located at P.O. Box 6987, Freehold, New Jersey 07728, in the amount of up to One Hundred Sixty-Eight Thousand Forty-Nine Dollars and Zero Cents ($168,049.00) for the Sustaining Local Public Health Infrastructure Grant, for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic, for the period commencing on July 1, 2024 through March 31, 2026. The acceptance of NJACCHO COVID-19 reimbursement funds does not require the expenditure of any municipal funds.
