WHEREAS, the Essex County Open Space Trust Fund's 2009 Open Space Local Aid Program (the "Open Space Program") has made funds available to assist Essex County municipalities with projects that qualify for funding from the Essex County Recreation and Open Space Trust Fund, with no City funds required; and
WHEREAS, pursuant to Resolution 7R3-c, adopted April 15, 2009, the Municipal Council of the City of Newark authorized the Mayor and/or his designee the Urban Designer/Waterfront Planner to submit an application for, to accept, and to enter into an agreement for grant funding in the amount of $225,000.00 from the Open Space Program to design and develop the first phase of the Newark Riverfront Park a/k/a Minish Park (the "Park"), with no City funds required; and
WHEREAS, pursuant to Resolution 7R1-j, adopted January 6, 2010, the Municipal Council of the City of Newark authorized the Business Administrator and the Deputy Mayor/Director of Economic and Housing Development to enter into and execute a Pass Through Agreement with the Trust for Public Land, 20 Community Place, Morristown, NJ 07960, for the grant award in the amount of $225,000.00 from the Open Space Program to develop and make improvements within the "Park", for the period commencing on January 6, 2010 and terminating on June 30, 2010; and
WHEREAS, on July 14th, 2010 the County of Essex Department of Parks, Recreation and Cultural Affairs advised the City of Newark in writing that the expiration date for the Open Space Program grant period had been extended from June 30, 2010 through December 31, 2010; and
WHEREAS, pursuant to Resolution 7R1-c, adopted November 4, 2010, the Municipal Council of the City of Newark authorized the Business Administrator and the Deputy Mayor/Director of Economic and Housing Development to enter into and execute an amending agreement with the Open Space Program to extend the expiration date for the grant award from June 30, 2010 through December 31, 2010; and
WHEREAS, Resolution 7R1-c, adopted November 4, 2010, further authorized the City of Newark to enter into an amending agreement with Trust for Public Land to extend the expiration date for the Pass Through Agreement from June 30, 2010 through December 31, 2010 to allow them to complete design and development of the Park; and
WHEREAS, on November 21, 2011, the County of Essex Department of Parks, Recreation and Cultural Affairs, advised the City of Newark in writing that the expiration date for the Open Space Program grant period had been further extended from December 31, 2010 through December 31, 2012; and
WHEREAS, the City of Newark desires to have Trust for Public Land continue to make these Improvements funded by the Open Space Program Grant and wishes to extend the expiration date for the Pass Through Agreement from December 31, 2010 to December 31, 2012; and
WHEREAS, all other terms and conditions of the grant agreement authorized by Resolution 7R3-c and the Pass Through Agreement authorized by Resolution 7R1-c, shall remain in full force and effect to the extent not otherwise amended.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, and/or his designees, the Business Administrator and the Deputy Mayor/Director of Economic and Housing Development are hereby authorized to enter into an amending agreement with the Essex County Open Space Trust Fund's 2009 Open Space Local Aid Program (the "Open Space Program") to extend the expiration date for the grant award to the City from June 30, 2010 through December 31, 2010 to permit the City to complete the design and development of the Newark Riverfront Park a/k/a Minish Park, with no City funds required.
2. The Mayor, and/or his designees, the Business Administrator and the Deputy Mayor/Director of Economic and Housing Development, are further authorized to enter into a second amended agreement with the Trust for Public Land, 20 Community Place, Morristown, NJ 07960, to extend the expiration date of the Pass Through Agreement from December 31, 2010 through December 31, 2012, to allow Trust for Public Land to complete the design and development of the Newark Riverfront Park a/k/a Minish Park, with no City funds required.
3. The Municipal Council hereby ratifies its authorization to extend the term of the grant agreement and the pass through agreement with the Trust for Public Land from December 31, 2010 to the date of adoption of this authorizing resolution.
4. The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully-executed copy of the resolution, the grant extension letter and any amended agreement authorized herein in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into an amending agreement with the Essex County Open Space Trust Fund's 2009 Open Space Local Aid Program (the "Open Space Program") to extend the expiration date of the grant period and extend the term of the pass through agreement with the Trust for Public Land, 20 Community Place, Morristown, NJ 079960 from December 31, 2010 through December 31, 2012, to complete the design and development of the Newark Riverfront Park a/k/a Minish Park, with no City funds required.
