WHEREAS, the City of Newark (the “City”) has a need to provide Animal Shelter Management Services animals that are a danger to human beings, injured, trapped, sick or endangered; and
WHEREAS, the City desires to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the citizens of the City of Newark pursuant to N.J.S.A. 40:48-2; and
WHEREAS, pursuant to N.J.S.A. 40:48-5.1, the City desires to enter into a contract for the period of May 1, 2026 through July 31, 2026, with the option to extend for an additional three (3) months, for a total amount not to exceed Four Hundred Sixty Thousand Dollars and Zero Cents ($460,000.00); and
WHEREAS, pursuant to N.J.A.C. 5:30-5.5 et seq., the Contract is subject to the availability and appropriation of sufficient funds; and
WHEREAS, the Contract shall be awarded as an open-ended contract and shall not exceed Four Hundred Sixty Thousand Dollars and Zero Cents ($460,000.00) for a three (3) month term with an option to extend for an additional three (3) months.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, are hereby authorized to extend the contract with Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the period of May 1, 2026 through July 31, 2026, with the option to extend for an additional three (3) months for an amount not to exceed Four Hundred and Sixty Thousand Dollars and Zero Cents ($460,000.00), for animal sheltering and impoundment services in the City of Newark.
2. The Contract shall be ratified back to May 1, 2026, to the date of adoption of this Resolution.
3. The Contract is awarded as an open-ended contract pursuant to N.J.A.C. 5:30-5.5. A Certification of Funds shall be executed each time services are used and charged against the contract.
4. Pursuant to N.J.A.C. 5:30-5.5, the Contract is subject to the availability and appropriations of sufficient funds.
5. Pursuant to N.J.A.C. 5:30-5.5, attached hereto is Comptroller’s partial certification which states that funds in the amount of One Hundred Fifty-Three Thousand Three Hundred Thirty-Three Dollars and Thirty-Three Cents are available in 2026 Budget under Business Units: NW011-011-120-1203-95920-B2026/NW011-011-200-2001-95920-B2026in the aforementioned Department of Health and Community Wellness. The balance of funding for the Contract amount for 2026 will be subject to appropriation in the 2026 Budget and funds will be certified prior to services being provided by the contractor.
6. Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Health and Community Wellness shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Health and Community Wellness beyond the extent to which monies are available.
7. A copy of the executed Contract and the Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.
8. If required by State Law, the City Clerk shall provide the appropriate notice of the award of the Contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10(a)and the Notice of the Office of the State Comptroller dated July 7, 2025.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, to enter into and execute an open-ended contract for three (3) months beginning May 1,2026 with an option to extend for an additional three (3) months, with the Associated Humane Societies, Inc., located at 124 Evergreen Avenue, Newark, New Jersey 07114. The amount shall not exceed Four Hundred Sixty Thousand Dollars and Zero Cents ($460,000.00), for animal sheltering and impoundment services in the City of Newark.
