WHEREAS, on September 16, 2020 through Resolution 7R2-c, the Municipal Council authorized the Mayor of the City of Newark to accept the following Workforce Innovation Opportunity Act (WIOA) allotments: WIOA - Youth ($2,553,043.00), WIOA - Adult ($2,393,169.00), WIOA - Dislocated Worker ($750,427.00); totaling $5,696,639.00 through the Newark Workforce Development Board (NWDB) grant funds for Program Year 2020 (July 1, 2020 through June 30, 2021) with eighty percent (80%) obligated by June 30, 2021 and fully expended by June 30, 2022; and

 

WHEREAS, there exists a need for NewarkWORKS to enter into a contract with an entity that can provide WIOA-Youth clients for pre-high school and high school equivalency pursuant to the provisions of WIOA Program Year 2020; and

 

WHEREAS, on March 27, 2020, NewarkWORKS advertised a Request for Proposal (RFP), returnable on May 22, 2020 for training services under the provisions of WIOA Program Year 2020; and

 

WHEREAS, on May 22, 2020, NewarkWORKS received a total of twenty-five (25) proposals for both WIOA Youth and Adult which were opened on the same day and entered on a tabulation bid sheet, a copy of which is attached; and

 

WHEREAS, the selection committee reviewed the proposal received from La Casa de Don Pedro, and approved by NWDB, and found it to be advantageous to the City of Newark based upon price, experience and all other criteria listed in the RFP; and

 

WHEREAS, NewarkWORKS wishes to enter into a one (1) year contract with La Casa de Don Pedro to provide pre-high school and high school equivalency prep program, which is inclusive of academic remediation, work-based learning activities, financial literacy, case management, and career counseling for twenty (20) WIOA-Youth clients for an amount not to exceed Sixty Thousand Dollars and Zero Cents ($60,000.00) for Program Year 2020; and

 

WHEREAS, the Municipal Council wishes to authorize and ratify the use of competitive contracting for processing WIOA programs from July 1, 2020 to the date of adoption of this authorizing resolution and the use in the future; and

 

WHEREAS, this contract is for library and educational goods and services which is exempt from the requirement of public biding, pursuant to State and Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(q); and

 

WHEREAS, this contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and

 

WHEREAS,  the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark Municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Deputy Mayor of Workforce Development and Director of One Stop Career Center/NewarkWORKS  are authorized to enter into and execute a contract with La Casa de Don Pedro, 75 Park Avenue, Newark, New Jersey 07104, to provide pre-high school and high school equivalency prep program which is inclusive of academic remediation, work-based learning activities, financial literacy, case management, and career counseling to twenty (20) WIOA-Youth clients for Program Year 2020.  The contract shall be established during the period commencing on July 1, 2020 and terminating on June 30, 2021 for an amount not to exceed $60,000.00.  The term of the contract will be established for one (1) year.

 

2.                     This contract between the City of Newark and La Casa de Don Pedro is hereby ratified from July 1, 2020 to the date of adoption of the authorizing resolution.

 

3.                     The contract is subject to availability of funds from the United States Department of Labor, Employment and Training Administration, Workforce Innovation and Opportunity Act of 2014 through the New Jersey Department of Labor and Workforce Development, with eighty percent (80%) obligated by June 20, 2021 and fully expended by June 30, 2022 or retuned to the State.

 

4.                     Attached hereto is Certification of Funds from the Director of the Department of Finance, which states: (1) that there are sufficient funds, in the amount of $60,000.00, for purpose set forth here in above; and (2) that the line appropriation of the Official Budget which shall be charged is: Business Unit NW051, Dept. G20, Div./Proj. M20D0, Account # 72060, Budget Ref: B2020.

 

5.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

6.                     There shall be no amendment or changes to this contract without approval of the Municipal Council.

 

7.                     The Deputy Mayor of Workforce Development and/or the Director of One Stop Career Center/NewarkWORKS shall file forth with a copy of the fully executed contract with the Office of the City Clerk and shall be made available for public inspection.
