WHEREAS, on November 7, 2011, by Resolution 7R1-I 110711 the City of Newark Municipal Council authorized the Mayor and/or his designee the Purchasing Director to enter into a contract with LEW Corporation, 1090 Bristol Rd., Mountainside, NJ 07092, to provide Lead Hazard Control and Reduction Services, for a two year term to the City of Newark; and
WHEREAS, LEW Corporation is one (1) of nine (9) vendors in this multiple award; and
WHEREAS, on January 9, 2012, the City of Newark's Purchasing Division received written notice from the President of LEW Corporation, withdrawing his company from further consideration and returning unsigned contract # S114099-9-9; and
WHEREAS, the Purchasing Director requests that the Municipal Council rescind the award to LEW Corporation for the provision of Lead Hazard Control and Reduction Services to the City of Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The award of Contract #S114099-9-9, to LEW Corporation, as a result of the adoption of Resolution 7R1-I 110711, be rescinded, for the provision of Lead Hazard Control and Reduction Services to the City of Newark.
2. The City Clerk will notify LEW Corporation, 1090 Bristol Rd., Mountainside, NJ 07092 that the City has rescinded the contract award.
3. The remaining awards, terms, conditions and not to exceed amount authorized by 7R1-I 110711 remains unchanged.
STATEMENT OF INTENT:
This resolution amends Resolution 7R1-I 110711 by rescinding the award to LEW Corporation, to provide Lead Hazard Control Reduction Services. The remaining awards, terms, conditions and amount not to exceed remains unchanged.
