WHEREAS, pursuant to Resolution 7R9-a(S) adopted on October 12, 2016 the Municipal Council supported the issuance of a Hold Harmless and Indemnification Agreement for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark” at Edison Parking Corporation, 110 Edison Place 1st Floor, Newark, New Jersey 07102, on Friday, October 14, 2016 from 6:00 P.M. until 10:00 P.M. and Saturday, October 15, through Sunday, October 23, 2106 from 12:00 P.M. until 7:00 P.M.; and
WHEREAS, it has been requested by the beneficiary, Newark Warehouse Redevelopment Company, LLC, that the Hold Harmless and Indemnification Agreement for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark” scheduled for Friday, October 14, 2016 from 6:00 P.M. until 10:00 P.M. and Saturday, October 15, through Sunday, October 23, 2106 from 12:00 P.M. until 7:00 P.M. be amended to reflect the exact event dates and timeframe.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R9-a(S) adopted on October 12, 2016, is hereby amended to reflect that the Municipal Council of the City of Newark supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission for the benefit of Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, Newark, New Jersey 07102 for any claims arising out of the City of Newark’s use of property owned by the Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, 1st Floor, Newark, New Jersey 07102 for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark,” sponsored by Councilman Augusto Amador, from Friday, October 14, 2016 from 6:00 P.M. until 10:00 P.M. and Saturday, October 15, through Sunday, October 23, 2106 from 12:00 P.M. until 7:00 P.M., and/or including any re-scheduled Rain Date.
2. This authorizing resolution is hereby ratified from October 14, 2016 to the date of adoption by the Municipal Council.
3. The City Clerk, on behalf of the Newark Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, Newark, New Jersey 07102 for their records.
4. A copy of the executed Hold Harmless and Indemnification Agreement, drawn by the Insurance Fund Commission, shall be filed in the Office of the City Clerk.

This resolution hereby amends Resolution 7R9-a(S) adopted on October 12, 2016, to reflect that the Municipal Council supports the issuance, by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement for the benefit of the Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, Newark, New Jersey 07102, for any claims arising out of the City of Newark’s use of property owned by Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, 1st Floor, Newark, New Jersey 07102, on Friday, October 14, 2016 from 6:00 P.M. until 10:00 P.M. and Saturday, October 15, through Sunday, October 23, 2106 from 12:00 P.M. until 7:00 P.M., and/or including any re-scheduled Rain Date for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark,” sponsored by Councilman Augusto Amador.
