ORDINANCE AMENDING AND SUPPLEMENTING TITLE II, ADMINISTRATION, CHAPTER 20, DEPARTMENT OF PUBLIC SAFETY, DIVISION OF FIRE, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY ADDING A NEW SECTION TO INCLUDE TRAINING OF OUTSIDE PERSONNEL AT NEWARK FIRE ACADEMY, WHICH AUTHORIZES AND ESTABLISHES FEES AND PROCEDURES FOR TRAINING AT THE NEWARK FIRE ACADEMY OF FIREFIGHTERS WHO ARE NOT MEMBERS OF THE NEWARK FIRE DIVISION.

WHEREAS, the City of Newark, Department of Public Safety, Division of Fire, operates a firefighting training academy (“Newark Fire Academy”) to train members of the Newark Fire Division; and

 

WHEREAS, the City of Newark, Department of Public Safety, Division of  Fire, also allows members of other Municipal Fire Departments to attend the Newark Fire Academy to receive training in both basic firefighting courses and in certain other specialized firefighting and emergency-response courses; and

 

WHEREAS, the City of Newark, Director of Public Safety, recommends that fees be established to outside personnel Fire Departments for training received at the Newark Fire Academy in order to recoup the City of Newark’s costs associated therewith; and

 

WHEREAS, the City of Newark, Director of Public Safety, also recommends that certain general protocols and procedures be established for firefighters from other local Fire Departments to enroll in the Newark Fire Academy.

 

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

Section 1:                     Title II, Administration, Chapter 20, Department of Public Safety, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is hereby amended by the insertion of the following new Article:

 

NEW SECTION                     Training of Outside Personnel at Newark Fire Academy

 

NEW SUB-SECTION                     Fees for Enrollment in Newark Fire Academy by Outside Personnel

 

There is hereby established the following fees for the training of personnel from outside agencies at the Newark Fire Academy:

NEW SUB-SECTION                     Payment and Disposition of Fees

 

                     Fees for Newark Fire Academy Training Courses shall be made by check made payable to the City of Newark and directed to the Newark Fire Division.  The Newark Fire Division shall promptly deposit said funds in the Newark Fire Outside Training Fees account 011 050 0505 54180 in the Revenue Collections Division.

 

NEW SUB-SECTION                     Insurance and Hold Harmless Requirements

 

                     a.                     The trainee’s sponsoring agency shall maintain for the duration of the training course, at its sole cost and expense, insurance against claims for injuries to persons or damages to property which may arise from or in conjunction with the actions or inactions of the sponsoring agency’s trainee during the training course.  The insurance shall be in the minimum amounts of $1,000,000.00 per occurrence and $2,000,000.00 aggregate, and the City of Newark must be named as an additional insured under the policy. 

 

                     b.                     The trainee’s sponsoring agency shall maintain for the duration of the training course, at its sole cost and expense, Workmen’s Compensation Insurance with minimum limits of $500,000.00 each accident and $500,000.00 policy limit.

 

c.                     Appropriate Certificates of Insurance and Endorsements of Additional Insured status must be produced prior to the trainee beginning a training course.

 

d.                     Both the trainee and the trainee’s sponsoring agency shall execute Hold Harmless Agreements prior to the trainee beginning a training course.  Said Hold Harmless Agreements shall be in forms acceptable to the City of Newark’s Corporation Counsel.

 

NEW SUB-SECTION                     Administration

 

                     The Newark Public Safety Director is charged with the administration of the provisions of this Article, and is empowered to prescribe, adopt, promulgate and enforce rules and regulations relating to any matter pertaining to the administration of this Article.

 

Section 2:                     Any prior ordinances or parts thereof inconsistent herewith are hereby repealed.

 

Section 3:                     If any part of this Ordinance is declared unconstitutional or illegal, the remaining provisions shall continue in full force and effect.

 

Section 4:                     This Ordinance shall take effect upon final passage and publication in accordance with  the laws of the State of New Jersey.

 

STATEMENT

 

This Ordinance amends and supplements the Revised General Ordinances of the City of Newark, New Jersey, 2000, Title II, Administration, Chapter 20, Department Of Public Safety, by adding provisions which authorize and establish fees and procedures for training personnel at the Newark Fire Academy who are not members of the Newark Fire Division.
