NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. Title 34:2-2 is hereby amended to read as follows:
34:2-2 AUTOCAB LICENSE AND CERTIFICATE OF COMPLIANCE REQUIRED.
a. No person shall operate or permit an autocab owned or controlled by him or her to be operated as an autocab upon the streets of the City of Newark without first obtaining an autocab license and a valid driver’s license from the City of Newark, Division of Taxicabs; a certificate of compliance from the City Clerk; and livery plates from the Division of Motor Vehicles of New Jersey (DMV) if:
1. His or her principal place of business is in the City of Newark;
2. His or her base is in the City of Newark; or
3. The majority of his or her autocab business is in the City of Newark.
b. Each person operating an autocab within the City of Newark shall be affiliated and /or associated with a base.
c. No person who owns or controls an autocab or autocab license shall permit the autocab to be driven, unless the driver of the autocab has first obtained and is currently a holder of a valid driver’s license issued by the City of Newark.
d. The number of outstanding autocab licenses issued by the City of Newark shall be limited to 700 active autocab licenses.
Section 2. Any person that desires to operate an autocab in the City of Newark must comply with all of the requirements of this ordinance upon its effective date.
Section 3. Any and all ordinances or parts thereof inconsistent herewith are hereby repealed.
Section 4. This ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
The purpose of this Ordinance is to require certification of all autocab drivers and limit the number of auto cabs to 700.
