Resolution 7R3-a adopted on October 4, 2023, awarded a contract in an amount not to exceed $4,247,945.00 for a contract period of (365) days from the effective date of the written Notice to Proceed or May 6, 2024 through May 6, 2025.
This Amending Resolution will extend the term of the contract by six (6) additional months, from May 6, 2025 through November 6, 2025, at no additional cost to the City of Newark.

WHEREAS, Resolution 7R3-a, adopted on October 4, 2023, authorized the Acting Director of the Department of Engineering to accept the bid proposal by Rockborn Trucking and Excavation Inc., 12 Taylor Road, Wharton, New Jersey, 07885, and execute Contract #2022-04, LFIF-19 Doremus Avenue Port Newark Connect project, for the total bid amount not to exceed Four Million Two Hundred Forty-Seven Thousand Nine Hundred Forty-five Dollars and Zero cents ($ 4,247,945.00); and
WHEREAS, the original contract term was 365 days from the effective date of the issuance of the Notice to Proceed, or May 6, 2024 through May 6, 2025; and
WHEREAS, the Acting Director of the Department of Engineering requests an extension of the contract term for an additional six (6) month, from May 6, 2025 to November 6, 2025, with such additional extensions as required to complete the construction of Local Freight Impact Fund-19, Doremus Avenue Port Newark Connect project as permitted by the Local Contracts Law, N.J.S.A. 40A:11-15(9).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, and/or his designee, the Acting Director of the Department of Engineering, is hereby authorized on behalf of the City of Newark to issue Change Order No. 1 and execute a Contract Amendment for six (6) month extension of the term of Contract No. 2022-04, with Rockborn Trucking and Excavation, Inc.,12 Taylor Road, Wharton, New Jersey, 07885, for the LFIF-19 Doremus Avenue Port Newark Connect project, from May 6, 2025 to November 6, 2025, with no additional cost to the City of Newark.
2. A fully executed copy of Change Order No. 1/Contract Amendment to Contract No. 2022-04, shall be filed in the Office of the City Clerk by the Acting Director of Engineering.
3. No other changes to this contract are allowed without prior Municipal Council approval.
4. Any further extensions, as may be permitted by N.J.S.A. 40A:11-15(9), are subject to Municipal Council approval.
5. Notice of this Change Order for a professional services contract, in accordance with N.J.S.A. 40A:11-5(1)(a)(i), shall be published in the official newspaper of the municipality, which notice shall be filed in the Office of the City Clerk for inspection by the public.
6. The authorization granted by this Resolution is ratified back to May 6, 2025.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to issue and execute Change Order #1/Contract Amendment to Contract #2022-04, with Rockborn Trucking and Excavation, Inc., 12 Taylor Road, Wharton, New Jersey, 07885, for the LFIF-19 Doremus Avenue Port Newark Connect project, from May 6, 2025 to November 6, 2025, with no additional cost to the City of Newark.
