Body

 

WHEREAS, the City of Newark wishes to purchase a Virtual Law Enforcement Training System, from an authorized vendor under the Government Service Administration (GSA) Federally-Based Contracts; and

 

WHEREAS, P.L. 110-248, The Local Preparedness Acquisition Act, signed June 26, 2008, authorizes state or local governments the use of the Federal Supply Schedule of the General Service Administration (GSA) to purchase alarm and signal systems, facility management systems, firefighting and rescue equipment, law enforcement and security equipment, marine craft and related equipment, special purpose clothing, and related services; and

 

WHEREAS, the State 2004 Appropriations Act, P.L.2004, c. 71, and as described by the Division of Local Government Services in Local Finance Notices (LFN) 2004-21 and further reiterated as option No. 4 in Local Finance Notice (LFN) 2009-20, allows local units to purchase goods from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contracts Law, and through this resolution and properly executed contracts, the City of Newark plans to use such contracts to undertake the purchase a Virtual Law Enforcement Training System (FATS® L7 Law Enforcement Simulator); and

 

WHEREAS, the City of Newark Supervising Procurement Specialist concludes that bidding is not practical to meet acquisition timing or other criteria appropriate to the circumstances; and

 

WHEREAS, the desired goods or services to be purchased through a Federally-Based Contract are not available under existing State contract(s) or other in-State procurement; and

 

WHEREAS,                     the Police Department, Training Academy, recommends utilization of GSA schedule GS-02F-0414D with Meggitt Training Systems Inc. 296 Brogdon Road, Suwanee, Georgia 30024, to procure a Virtual Law Enforcement Training System (FATS® L7 Law Enforcement Simulator); and

 

WHEREAS, Meggitt Training Systems Inc., 296 Brogdon Road, Suwanee, GA 30024, is participating in a federal procurement program established by a federal department or agency and is the holder of General Services Administration Contract GS-02F-0414D; and

 

WHEREAS, Meggitt Training Systems, Inc. has represented that it is qualified by its experience and reputation for reliability and longevity to provide a Virtual Law Enforcement Training System in a manner consistent with the terms and conditions set forth in the GSA contract; and

WHEREAS, Meggitt Training System Inc., is the sole source of the Virtual Law Enforcement Training System (FATS® L7 Law Enforcement Simulator); and

 

WHEREAS, the total cost for the purchase of the Virtual Law Enforcement Training System is expected to not exceed $104,512.00.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     Pursuant to P.L. 110-248, The Local Preparedness Acquisition Act , State 2004 Appropriations Act, P.L.2004, c. 71, LFN 2004-21, and LFN 2009-20 municipalities are authorized to use federal grant funds to procure homeland security equipment, supplies and services relevant to disaster recovery through the use of the Federal Supply Schedule of the General Service Administration (GSA).

 

2.                     The Mayor and or his designee, the Business Administrator and or the Supervising Procurement Specialist are hereby authorized to procure the services of Meggitt Training Systems, Inc., 296 Brogdon Road, Suwanee, Georgia 30024 though GSA Contract GS-02F-0414D for a Virtual Law Enforcement Training System (FATS® L7 Law Enforcement Simulator), to be delivery no later than April 30, 2016.  The total cost for the purchase of the Virtual Law Enforcement Training System is expected to not exceed $104,512.00There shall be no amendment of this resolution without the approval of the Municipal Council.

 

3.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16. Funds for expenditures against this contract are contingent upon appropriation; pursuant to N.J.A.C. 5:30-5.5.

 

4.                     Funds to procure this Virtual Law Enforcement Training System are encumbered on Purchase Order #1912, FUND NW026, ACCOUNT 46570, and BUDGET B2015 for $104,512.00. This purchase shall not exceed $104,512.00.

 

5.                     This contract complies with New Jersey Delegated Purchase Authorization (DPA) Purchases and Contracts Via Federally-Based Programs, including but not limited to the U.S. General Services Administration (“GSA”).

 

6.                     The Supervising Procurement Specialist has attached hereto, a duly executed copy of the GSA Schedule to be filed in the Office of the City Clerk.

 

7.                     If required by State Law, the City Clerk shall provide the appropriate notice of the usage of this GSA Schedule, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This resolution authorizes usage of a U.S. General Services Administration (“GSA”) schedule GS-02F-0414D, for Meggitt Training Systems Inc., to procure a Virtual Law Enforcement Training System, at a cost not to exceed $104,512.00, upon delivery, no later than April 30, 2016.
