WHEREAS, Victoria Foundation, 31 Mulberry Street, Newark, New Jersey 07102, desires to support the City of Newark through its transitional period; and
WHEREAS, the Victoria Foundation desires to underwrite a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall; and
WHEREAS, the funds will cover the costs and expenses for twenty-six (26) existing and newly appointed municipal executives that will be professionally facilitated and will include sessions related to teambuilding, understanding current challenges, setting priorities, strategic planning, ethics and budget/resource allocation; and
WHEREAS, the Trustees of the Victoria Foundation voted for the Community Foundation of New Jersey located at 35 Knox Hill Road, Morristown, New Jersey to assist in the receipt and distribution of the gift in the amount of ten thousand dollars ($10,000.00) to the City of Newark to be used for the sole purpose of funding the costs and expenses for a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall for the period of July 15, 2014 through August 31, 2014; and
WHEREAS, Victoria Foundation and Community Foundation of New Jersey fully understand and agree that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift (letter attached); and
WHEREAS, the Mayor and/or his designee the Assistant Business Administrator desires to accept the gift of a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall for the period of July 15, 2014 through August 31, 2014; and
WHEREAS, pursuant to Local Public Contracts Law (N.J.S.A.40A:5-29) a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, the Mayor and the Municipal Council determine that it is the best interest of the City to accept the gift for a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall which is valued at $10,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNCIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Assistant Business Administrator, are authorized to accept the gift from the Victoria Foundation through the Community Foundation of New Jersey to the City of Newark to be used for the sole purpose of funding the costs and expenses for a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall for the period of July 15, 2014 through August 31, 2014 valued at ten thousand dollars ($10,000.00).
2. The acceptance of the gift is ratified from July 15, 2014 to the date of adoption of this authorizing resolution.
3. No municipal funds will be expended for the acceptance of this gift.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee the Assistant Business Administrator to accept the gift from the Victoria Foundation through the Community Foundation of New Jersey to the City of Newark to be used for the sole purpose of funding the costs and expenses for a two (2) day off-site leadership retreat for Mayor Baraka and his leadership team in City Hall for the period of July 15, 2014 through August 31, 2014 valued at ten thousand dollars ($10,000.00) with no municipal funds to be expended.
