Original Resolution 7R5-a adopted on April 7, 2020 awarded a contract in an amount not to exceed $20,000.00 for a period of January 1, 2020 through December 31, 2020.

 

This resolution will increase the contract amount by $653,678.00 for a total contract amount not to exceed $673,678.00 extending the period through July 28, 2022 for additional services to prevent, prepare for, and respond to coronavirus.

WHEREAS, through Resolution 7R5-a adopted on April 7, 2020, the City of Newark authorized an award of a contract to Newark Emergency Services for Families, Inc., as a Sub-Recipient of ESG grant funding for the period of January 1, 2020 through December 31, 2020, to provide certain emergency services for an amount not to exceed Twenty Thousand Dollars and Zero Cents ($20,000.00); and

 

WHEREAS, on March 27, 2020, to assist communities in their efforts to prevent, prepare for and respond to the Coronavirus Pandemic (COVID-19), the Federal Coronavirus Aid Relief and Economic Security (CARES) Act was signed into law and included supplemental formula allocations to HUD’s Community Planning and Development programs, with allocations of $4,310,416.00 in CDBG funds, $7,621,389.00 in ESG, and $842,513.00 in HOPWA funds for the City of Newark; and

 

WHEREAS, the CARES Act provides additional funds specifically for addressing COVID-19 related impact and expense of services from July 28, 2020 through July 28, 2022; and

 

WHEREAS, this contract allocates supplemental funds provided under the CARES Act to ESG grantees as additional funding to maintain operations, and for rental assistance and other necessary actions, to prevent, prepare for, and respond to coronavirus for persons who are homeless or at risk of becoming homeless; and

 

WHEREAS, the City of Newark (the “City”), desires to continue to act as the Grantee/Sub-Grantor for disbursement of funds made available by the United States Department of Housing and Urban Development (HUD), Emergency Solutions Grants (ESG) Program, CARES Act, to prevent, prepare for, and respond to coronavirus for persons who are homeless or at risk of becoming homeless; and

 

WHEREAS, Newark Emergency Services for Families, Inc. is a Sub-Recipient of the ESG grant funding and therefore is eligible to receive supplemental funds under the CARES Act; and

 

WHEREAS, as more fully set forth in the scope of services (attached hereto) the City seeks to provide rental assistance to persons who are homeless or at risk of becoming homeless, provided for through the CARES Act additional funds; and

 

WHEREAS, the term of the Contract is amended and ratified back to July 28, 2020, with allowable recoupment of COVID 19 related expenses stemming from January 21, 2020; and

 

WHEREAS, provided by the CARES Act, these supplemental funds may be used to reimburse allowable costs as of the date a Sub-Recipient began preparing for coronavirus, which HUD shall presume to be no earlier than January 21, 2020; and

 

WHEREAS, an increase in the amount of Six Hundred Fifty-Three Thousand Six Hundred Seventy-Eight Hundred and Zero Cents ($653,678.00) to the current contract is necessary to prevent, prepare for and respond to COVID 19; and

 

WHEREAS, the Twenty Thousand Dollars and Zero Cents ($20,000.00) of ESG funds from the underlying grant agreement must be used by December 31, 2020 and the One Hundred Thousand Dollars and Zero Cents ($100,000.00) CARES Act funding for supplemental COVID 19 related expenses awarded under this agreement must be expended by July 28, 2022; and

 

WHEREAS, the City of Newark is in receipt of a request from the Department of Health and Community Wellness to increase the “not to exceed” amount from Twenty Thousand Dollars and Zero Cents ($20,000.00) to Six Hundred Fifty-Three Thousand Six Hundred Seventy-Eight Hundred and Zero Cents ($653,678.00).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE

                     CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Department of Health and Community Wellness is hereby authorized to ratify and amend contract with Newark Emergency Services for Families, Inc. to provide programmatic activities to prevent, prepare for, and respond to the coronavirus pandemic by increasing the contract amount from Twenty Thousand Dollars and Zero Cents ($20,000.00) to Six Hundred Fifty-Three Thousand Six Hundred Seventy-Eight Hundred and Zero Cents ($653,678.00).

 

2.                     The contract amendment is ratified from July 28, 2020 through July 28, 2022, and the date of adoption of the authorizing Resolution, 7R5-a adopted on April 7, 2020, is specific to the ESG-CV funds increase of Six Hundred Fifty-Three Thousand Six Hundred Seventy-Eight Hundred and Zero Cents ($653,678.00).

 

3.                     Attached hereto is a Certification of Funds from the Municipal Comptroller of the City of Newark, which states that there are sufficient funds for the purpose set forth hereinabove: 2020 Budget/Department of Health and Community Wellness/NW 051; Dept. ID G20; Division/Project 2H211; Account# 72030; Budget Ref. B2020

 

4.                     The services to be provided pursuant to the original ESG grant award of Twenty Thousand Dollars and Zero Cents ($20,000.00) terminates December 31, 2020. The supplemental grant award of Six Hundred Fifty-Three Thousand Six Hundred Seventy-Eight Hundred and Zero Cents ($653,678.00) under the CARES Act funding for COVID 19 related expenses awarded under this agreement must be expended by July 28, 2022, thereby extending the terms and conditions of the contract authorized by Resolution 7R5-a adopted on April 7, 2020, as to the supplemental funding and the extension of time.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the actions taken by the Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, to amend the contract with Newark Emergency Services for Families, Inc. utilizing ESG funding, for the provision of emergency services to the homeless and those at risk of being homeless in the City of Newark, in an amount not to exceed $673,678.00.  The supplemental grant award of $653,678.00 under the CARES Act funding for COVID 19 related expenses awarded under this agreement must be expended by July 28, 2022, thereby extending the terms and conditions of the contract authorized by Resolution 7R5-a adopted on April 7, 2020, but solely as to the supplemental funding.
