WHEREAS, there is a continuing national and local outcry and debate about controversial police conduct and the use of force against African Americans and minorities and people of color resulting in disruptions, demonstrations and death; and

 

WHEREAS, the Office of the Mayor has determined that there is still a need for education of the citizens of Newark to engage in peaceful protest alternatives and to foster better relations between the police and the community of Newark; and

 

WHEREAS, the Office of the Mayor, with a mission to eradicate or diminish violence in the City of Newark, is desirous of procuring services of  proposers with expertise and reputation in conducting pro-peace and anti-violence cultural events, in a manner that engages peaceful, tasteful and artistic expression in neighborhoods; and

 

WHEREAS, the Office of the Mayor and the Department of Recreation, Cultural Affairs and Senior Services are desirous of having an annual anti-violence, pro-peace engagement program to inform the citizens of Newark and the viewing public about peaceful protest alternatives, to foster better relations between the police and the community, and aimed at addressing violence and promoting effective policing through the performing arts including, artists, speakers and celebrities requiring support equipment, services and promotions  organized with  parents, children, artists, business owners, faith based and community organizations; and

 

WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) provides for the use of competitive contracting in lieu of public bidding for the procurement of specialized goods or services, the price of which exceeds the threshold, for “the hiring of a for-profit or a not-for-profit entity incorporated under Title 15A of New Jersey Statures for the purpose of: the operation, management or administration of recreation or social service facilities or programs;” and

 

WHEREAS, the Mayor is desirous of procuring these services through the competitive contracting procurement process; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4.3 (a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and

 

WHEREAS, the competitive contracting process shall be administered by the Business Administrator and the Supervising Procurement Specialist of the City of Newark pursuant to N.J.S.A. 40A: 11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of N.J.S.A. 40A:11-11.4.5(e).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council authorizes the Mayor, Business Administrator and/or the Supervising Procurement Specialist to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1 et seq., to procure anti-violence, pro-peace engagement program services.

 

2.                     The competitive contracting process shall be administered by the Business Administrator and/or the Supervising Procurement Specialist, pursuant to N.J.S.A. 4-A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of subsection (e) of N.J.S.A. 40A: 11-4.5.

 

STATEMENT

 

This resolution authorizes the Mayor, Business Administrator and/or the Supervising Procurement Specialist, to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1 et seq., to procure anti-violence, pro-peace engagement program services aimed at eradicating or diminishing violence in the City of Newark, and informing the citizens of Newark about peaceful protest alternatives and to foster better relations between police and the community.
