Emergency Contract #E2025-08 was awarded on behalf of the Department of Public Safety for the period March 27, 2025 through July 26, 2025, in an amount not to exceed $379,000.00.
The extension of this contract will be for an additional (90) days, effective as of June 26, 2025.

WHEREAS, on March 26, the Department of Public Safety requested a declaration of emergency for immediate relocation of property and evidence seized by the Newark Police Division from location at 104 Arlington Street to a new facility at 775-793 Bergen Street; and
WHEREAS, on March 27, 2025, the Purchasing Agent accepted said request, which resulted in an emergency contract with Sher-Del Transfer, 171 Central Avenue Hillside, New Jersey 07205 in an amount not to exceed Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00); and
WHEREAS, on June 26, 2025, the Department of Public Safety requested a 90-day extension of Emergency Contract #E2025-08 due to unforeseen structural issues at the facility at 104 Arlington Street which limits entry to certain areas and consequently has delayed the move; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency arises potentially affecting the health, safety and welfare of residents; and
WHEREAS, local Ordinance 6PSF-e adopted on April 6, 2011 limits the period of emergency contracts to ninety (90) days and precludes extensions without Council authorization; and
WHEREAS, the Department of Public Safety now seeks ratification and authorization by the Municipal Council of Emergency Contract #E2025-08 to continue the relocation of police property and evidence to a new facility.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent, QPA, are hereby authorized to execute a ninety-day (90-day) extension of Emergency Contract #E2025-08 for relocation of property and evidence to a new facility with Sher-Del Transfer and Relocation Services 171 Central Avenue Hillside, NJ 07205. The not-to-exceed contract amount of Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00) shall remain unchanged.
2. The extension of Emergency Contract #E2025-08 is hereby ratified from June 26, 2025 to the date of adoption of this authorizing Resolution.
4. The Qualified Purchasing Agent for the City of Newark shall file copies of all documents related to Emergency Contract #E2025-08 with the Office of the City Clerk. Pursuant to ⸹2:5-13.2 of the City Code, the Purchasing Agent shall post the emergency contract on the City’s website within forty-eight (48) hours.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This Resolution ratifies and authorizes the Mayor, and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to extend the term of Emergency Contract #E2025-08 with Sher-Del Transfer and Relocation Services 171 Central Avenue Hillside, NJ 07205 The original not-to-exceed amount of Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00) shall remain the same.
