AN ORDINANCE AMENDING TITLE XXIII, TRAFFIC, CHAPTER 3, PROHIBITED TURNS, SECTION 23:3-5, NO TURNS ON RED, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY PROHIBITING RIGHT TURNS ON RED AT THE INTERSECTIONS OF DR. MARTIN LUTHER KING, JR. BOULEVARD, SUSSEX AVENUE AND CENTRAL AVENUE AND DR. MARTIN LUTHER KING, JR. BOULEVARD AND ORANGE STREET (CENTRAL WARD).

WHEREAS, the Department of Engineering, Division of Traffic and Signals, has determined the two (2) intersections of Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue and Dr. Martin Luther King, Jr. Boulevard and Orange Street in the Central Ward qualifies for a “No Turns on Red” designation, from south on Dr. Martin Luther King, Jr. Boulevard to the west on Central Avenue and east on Orange Street to south on Dr. Martin Luther King, Jr. Boulevard, in accordance with the Manual on Uniform Traffic Control Devices; and
WHEREAS, such designation will improve safety and avoid pedestrian and vehicle conflicts at the intersections due to unforeseen upcoming traffic; and
WHEREAS, the Division of Traffic and Signals desires to improve safety at the two (2) signalized intersections of Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue and Dr. Martin Luther King, Jr. Boulevard and Orange Street in Central Ward by prohibiting right turns on red from south on Dr. Martin Luther King, Jr. Boulevard to the west on Central Avenue and east on Orange Street to south on Dr. Martin Luther King Jr. Boulevard.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
SECTION 1. Title XXIII, Traffic, Chapter 3, Prohibited Turns, Section 23:3-5, No Turns on Red, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, by adding the following:
Intersection Right Turn Prohibition
Dr. Martin Luther King, Jr. Boulevard, South on Dr. Martin Luther King, Jr.
Sussex Avenue and Central Avenue Boulevard to West on Central Avenue
Dr. Martin Luther King, Jr. Boulevard East on Orange Street to South on
and Orange Street Dr. Martin Luther King Jr. Boulevard
SECTION 2. Any existing Ordinances or parts thereof inconsistent with this Ordinance are hereby repealed.
SECTION 3. The Ordinance shall take effect take upon final passage and publication and in accordance with the laws of the State of New Jersey.
SECTION 4. The Ordinance does not require approval by Commissioner of Transportation.
SECTION 5. Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.
STATEMENT
This Ordinance authorizes the Department of Engineering, Division of Traffic and Signals, to improve pedestrian safety at the two (2) signalized intersections of Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue and Dr. Martin Luther King, Jr. Boulevard and Orange Street, in the Central Ward, by prohibiting vehicles from making a right turn on red from Dr. Martin Luther King, Jr. Boulevard to Central Avenue and Orange Street to Dr. Martin Luther King, Jr. Boulevard, whenever an official sign is present prohibiting a such turn
