This Resolution will amend Resolution 7R3-b, adopted on May 4, 2022, by increasing the grant funding from $4,856,257.51 to $7,689,808.92 ($7,237,610.51 for construction and $452,198.41 for construction inspection), by accepting additional funding in amount of $2,833,551.41

Whereas, Federal Highway Administration (FHWA) makes funds available for local transportation related projects of public entities of federal aid funds and those funds are administered by and through the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey Department of Transportation (NJDOT) for local safety programs; and

 

Whereas, on June 15, 2016, the Municipal Council adopted Resolution 7R4-e, which ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for, accept and enter into a grant agreement for grant funds in the amount of $3,475,000.00 for the Broad Street Pedestrian Safety Corridor Improvements; and

 

 

 Whereas, on February 22, 2022 NJDOT notified the City of Newark (“City”) that the FHWA authorized funding in the amount of $4,404,059.10 for construction and $452,198.41 for construction inspection for Broad Street Phase II Pedestrian Safety Improvements (a copy of the February 22, 2022 notification from the NJDOT is attached hereto and made a part hereof); and

  

            Whereas, on January 16, 2025, the  Department of Engineering held a public bid opening for Broad Street Phase II Pedestrian Safety Improvements, Contract #2022-01-2R, Federal Project number HSP-1865 (301) CON, and based on a review of the bids, the lowest responsive and responsible bidder J.A Alexander Inc., was selected for the Broad Street Phase II Pedestrian Safety Improvements project (“Project”) for the total bid amount not to exceed Seven Million Two Hundred Thirty-Seven Thousand, Six Hundred, Ten Dollars and Fifty-One Cents ($7,237,610.51) and

 

            Whereas, on October 15, 2025 the Department of Engineering requested additional funding from the FHWA in the amount of Two Million Eight Hundred Thirty-Three Thousand Five Hundred Fifty-One Dollars and Forty-One Cents ($2,833,551.41) needed for  the Project and

 

            Whereas, on December 4, 2025 FHWA approved an additional Two Million Eight Hundred Thirty-Three Thousand Five Hundred Fifty-One Dollars and Forty-One Cents ($2,833,551.41) in funding; and

 

            Whereas, the Department of Engineering seeks to amend Resolution 7R3-b 05/04/2022 to accept additional grant funds in the amount of Two Million Eight Hundred Thirty-Three Thousand Five Hundred Fifty-One Dollars and Forty-One Cents ($2,833,551.41), bringing the total funding authorized by the FHWA for the Broad Street Phase II Pedestrian Safety Improvements to Seven Million, Six Hundred Eighty- Nine Thousand Eight Hundred Eight Dollars and Ninety-Two Cents ($7,689,808.92), which includes Seven Million Two Hundred Thirty-Seven Thousand Six Hundred Ten Dollars and Fifty-One Cents ($7,237,610.51) for construction and Four Hundred Fifty-Two Thousand One Hundred Ninety-Eight Dollars and Forty-One Cents ($452,198.41) for construction inspection and management services.

 

 

        NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     Resolution 7R3-b adopted May 04, 2022 is hereby amended to authorize the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering  to accept any additional funding authorized by the Federal Highway Administration for the Broad Street Phase II Pedestrian Safety Improvements, including the additional grant funds from the New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT) in the amount of Two Million Eight Hundred Thirty-Three Thousand Five Hundred Fifty-One Dollars and Forty-One Cents ($2,833,551.41) (a copy of the NJDOT grant award letter is attached hereto and made a part hereof). The Mayor or the Director of the Department of Engineering is further authorized to enter into any grant agreement necessary to receive and expend said funds.

 

2.                     The  authority granted by this Resolution is ratified back to May 04, 2022.

 

3.                     No municipal funds are required in connection with the receipt or acceptance of this grant award.

4.                     The Director of the Department of Engineering shall file a fully executed copy of any grant/project agreement authorized by this Resolution in the Office of the City Clerk   

 

 

STATEMENT

 

This Resolution ratifies and authorizes an amendment to Resolution 7R3-b 05/04/2022 authorizing the acceptance of additional grant funds for the Broad Street Phase II Pedestrian Safety Improvements.  Funds authorized by the Federal Highway Administration increased from Four Million Eight Hundred Fifty-Six Thousand Two Hundred Fifty-Seven Dollars and Fifty-One Cents ($4,856,257.51) to Seven Million, Six Hundred Eighty-Nine Thousand Eight Hundred Eight Dollars and Ninety-Two Cents ($7,689,808.92) of which Seven Million Two Hundred Thirty-Seven Thousand Six Hundred Ten Dollars and Fifty-One Cents ($7,237,610.51) for construction and Four Hundred Fifty-Two Thousand One Hundred Ninety-Eight Dollars and Forty-One Cents ($452,198.41) for construction inspection and management services with no municipal funds required.
