Original Resolution 7R1-J was adopted on November 6, 2025, authorizing a contract with Unique Security & Consulting Services, LLC, to provide Armed Security Guards for an amount not to exceed $9,814,560.00, for a period not to exceed twenty-four (24) consecutive months.

WHEREAS, After advertising and public bidding in accordance with law therefor, Municipal Council Resolution 7R1-J adopted on November 6, 2025 authorized the Purchasing Agent, QPA (the “QPA”), to enter into and execute Contract 2025-41 with Unique Security & Consulting Services, LLC, 500 Paterson Plank Road, Union City, New Jersey 07087 (the “Contractor”), to provide surveillance and protection of the interior and exterior of authorized city locations (“Armed Security Guards”) in the amount not to exceed Nine Million Eight Hundred Fourteen Thousand Five Hundred Sixty Dollars and Zero Cents ($9,814,560.00), for a period not to exceed twenty-four (24) consecutive months; and
WHEREAS, as permitted by N.J.S.A. 40A:11-22 and N.J.S.A. 40A:11-23.1, section 3.12 of the bid specifications for Contract 2025-41 required the successful bidder to, simultaneously with the delivery of the executed contract, submit an executed bond in the amount of twenty-five percent (25%) of the acceptable bid as security for the faithful performance of the contract; and
WHEREAS, section 3.12 further stipulated that failure to submit said bond with the executed contract was grounds for declaring the executed contract null and void; and
WHEREAS, the Contractor has failed to provide the required performance bond within the time prescribed, which constitutes a material non-compliance with the terms and conditions of the bid specifications and contract and with the provisions of the Local Public Contracts Law and the City’s procurement policies; and
WHEREAS, due to said failure, the Department of Administration, Division of Central Purchasing, desires to rescind Resolution 7R1-J 11/06/2025 and to declare the contract null and void.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-J 11/06/2025 awarding Contract 2025-41 to Unique Security & Consulting Services, LLC, 500 Paterson Plank Road, Union City, New Jersey 07087 (the “Contractor”) is hereby rescinded and the contract with the Contractor declared null and void due to the Contractor’s failure to provide the required performance bond in accordance.

This Resolution rescinds Resolution 7R1-J adopted on November 6, 2025, for the award of a contract to Unique Security & Consulting Services, LLC, 500 Paterson Plank Road, Union City, New Jersey 07087, to provide Armed Security Guard services, in an amount not to exceed $9,814,560.00, for a period not to exceed twenty-four (24) consecutive months, due to the Contractor’s failure to provide the required performance bond.
