WHEREAS, the City of Newark (the “City”) has a need to provide Animal Shelter Management Services animals that are a danger to human beings, injured, trapped, sick or endangered; and
WHEREAS, the City desires to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the citizens of the City of Newark pursuant to N.J.S.A. 40:48-2; and
WHEREAS, pursuant to N.J.S.A. 40:48-5.1, the City desires to enter into a contract with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for a total contract amount not to exceed Two Million Eight Hundred Fifty-One Thousand Eight Hundred Thirty-Five Dollars and Zero Cents ($2,851,835.00), for the contract period commencing August 1, 2026 and terminating December 31, 2027, to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the City residents; and
WHEREAS, pursuant to N.J.A.C. 5:30-5.5 et seq., the Contract is subject to the availability and appropriation of sufficient funds; and
WHEREAS, the Contract shall be awarded as an open-ended contract period for August 1, 2026 -December 31, 2027 Two Million Eight Hundred Fifty-One Thousand Eight Hundred Thirty-Five Dollars and Zero Cents ($2,851,835.00); and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, are hereby authorized to extend the contract with Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for a total contract amount not to exceed Two Million Eight Hundred Fifty-One Thousand Eight Hundred Thirty-Five Dollars and Zero Cents ($2,851,835.00), for the contract period commencing on August 1, 2026 and terminating December 31, 2027, to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the City residents.
2. The Contract shall be ratified back to August 1, 2026, to the date of adoption of this Resolution.
3. The Contract is awarded as an open-ended contract pursuant to N.J.A.C. 5:30-5.5. A Certification of Funds shall be executed each time services are used and charged against the contract.
4. Pursuant to N.J.A.C. 5:30-5.5, the Contract is subject to the availability and appropriations of sufficient funds.
5. Pursuant to N.J.A.C. 5:30-5.5, attached hereto is Comptroller’s partial certification which states that funds in the amount of $334,000.00 from 2026 Budget under Business Units: NW011-120-A-1203-95920-B2026 and NW011-200-2001-A-95920-B2026, in the aforementioned Department of Health and Community Wellness. The balance of funding for the Contract amount for 2026 will be subject to appropriation in the 2026 Budget and funds will be certified prior to services being provided by the contractor ; 2027 Budget/Department of Health and Community Wellness/NW011-011-120-1203-95920-B2027 /NW011-011-200-2001-95920-B2027; balance of funding for this contract amount for 2027, will be subject to appropriation in the 2027 Budget and funds will be certified prior to services being provided by the contractor
6. Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Health and Community Wellness shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Health and Community Wellness beyond the extent to which funds are available.
7. Director of the Department of Health and Community Wellness shall file a copy of the fully executed Contract and the Certification of Funds, when made available in the Office of the City Clerk by the.
8. If required by State Law, the City Clerk shall provide the appropriate notice of the award of the Contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10(a)and the Notice of the Office of the State Comptroller dated July 7, 2025.
STATEMENT
This Resolution ratifies and authorizes the actions of the Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, to enter into and execute an open-ended contract with the Associated Humane Societies, Inc., located at 124 Evergreen Avenue, Newark, New Jersey 07114, for a total contract amount not to exceed Two Million Eight Hundred Fifty-One Thousand Eight Hundred Thirty-Five Dollars and Zero Cents ($2,851,835.00), for a contract period commencing on August 1, 2026 and terminating December 31, 2027, for animal sheltering and impoundment services in the City of Newark.
