WHEREAS, the City of Newark adopted Ordinance 6PSF-a on April 17, 2019, requiring the use of electronic database recording to assist law enforcement officials in recovering stolen gold, silver, precious and semiprecious metals, rhinestones, secondhand goods and/or other articles by requiring electronic reporting, maintenance and distribution criteria for secondhand and transient dealers; and
WHEREAS, the City of Newark, Department of Public Safety, Division of Police wishes to acquire an electronic data processing service to efficiently and effectively collect transaction data, identify trends, and aid in the recovery of stolen property; and
WHEREAS, on June 3, 2019, the City of Newark through its Purchasing Agent, QPA, advertised to solicit proposals for contractors to provide Operation Management and Administration of Data Processing Services for the Tracking of Items Sold by Secondhand Dealers for the Department of Public Safety, Division of Police, as described in the attached Request for Proposal; and
WHEREAS, the Division of Central Purchasing also distributed three (3) Request for Proposal (RFP) packages to prospective vendors following the date of advertisement; and
WHEREAS, the Division of Central Purchasing also published the Request for Proposal (RFP) package on the City of Newark’s website to provide broader access and download capability to potential respondents; and
WHEREAS, on June 27, 2019 the Division of Central Purchasing received one (1) proposal in response to this advertisement; and
WHEREAS, the proposal received from Business Watch International (U.S.) Inc. was most advantageous to the City of Newark based on experience and criteria listed on the Request for Proposal; and
WHEREAS, the Evaluation Committee recommended that an award be made to Business Watch International (U.S.) Inc., 7351 Wiles Road, Suite 102, Coral Springs, Florida 33067, in the best interest of the City prices and other factors considered; and
WHEREAS, the Purchasing Agent, QPA, concurs with the recommendation from the Evaluation Committee that a single award be made to Business Watch International (U.S.) Inc., 7351 Wiles Road, Suite 102, Coral Springs, Florida 33067; and
WHEREAS, pursuant to State Local Public Contracts Law N.J.S.A. 40A:11-4.1 (b)(3) competitive contracting process may be used for the operation, management or administration of data processing services; and
WHEREAS, the City of Newark wishes to enter into a contract with Business Watch International (U.S.) Inc. to provide Operation Management and Administration of Data Processing Services for the tracking of items sold by secondhand dealers; and
WHEREAS, the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator and/or the Director of Public Safety, are hereby authorized to enter into and execute a contract with Business Watch International (U.S.) Inc., 7351 Wiles Road, Suite 102, Coral Springs, Florida 33067, to provide Operation Management and Administration of Data Processing Services for the Tracking of Items Sold by Secondhand Dealers for the City of Newark, Department of Public Safety, Division of Police, whose proposal was received on the advertised due date and determined to be in the best interests of the City, price and other factors considered. The term of the contract will be established for a period not to exceed five (5) years, pursuant to N.J.S.A. 40A:11-15(5) from the date on which the contract is signed by City Officials.
2. There shall be no amendment or change of this contract without the approval of the Municipal Council.
3. The City of Newark shall not bear any costs or expenses in the use or implementation of the system. Business Watch International (U.S.) Inc. will directly bill stores $200.00 per store per year, covering the full search capabilities for pawn, scrap, and all secondhand dealers. Therefore, the City of Newark will not be involved with the billing or payment.
4. This contract is being awarded pursuant to the competitive contracting process under N.J.S.A. 40A:11-4.1(b)(3).
5. The Purchasing Agent, QPA, shall file a duly executed copy of this contract in the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
The resolution authorizes the Mayor and/or his designee, the Business Administrator and/or the Director of Public Safety, to enter into and execute a contract with Business Watch International (U.S.) Inc., 7351 Wiles Road, Suite 102, Coral Springs, Florida 33067, to provide Operation Management and Administration of Data Processing Services for the Tracking of Items Sold by Secondhand Dealers to the City of Newark, Department of Public Safety, Division of Police at no cost to the City of Newark for a period not to exceed five (5) years from the date in which a contract is signed by the City Officials.
