WHEREAS, the Essex County Recreation and Open Space Trust Fund has made funds available to assist Essex County municipalities with projects that qualify for funding from the 2014 Essex County Open Space Trust Fund Local Aid Program with no City funds required; and
WHEREAS, the Trust for Public Land ("TPL"), a national nonprofit organization dedicated to conserving land for recreation and open space purposes, is working with the City of Newark to design and construct Newark Riverfront Park Segment 3 between Congress to Van Buren Streets and between Somme to Oxford Street in the East Ward through its Parks for People - Newark program; and
WHEREAS, additional funds will allow for a larger capital improvement; and
WHEREAS, Department of Economic and Housing Development desires to further the public interest by obtaining funding in the amount of $150,000.00 from the Essex County Recreation and Open Space Trust Fund to design and construct the Newark Riverfront Park Segment 3; and
WHEREAS, on March 12, 2014, on behalf of the City of Newark, the Planning Director prepared and submitted a completed application to the Essex County Recreation and Open Space Trust Fund for grant funding in the amount of $150,000.00 from the 2014 Essex County Open Space Trust Fund Local Aid Program for the design and construction of Newark Riverfront Park Segment 3, with no City funds required; and
WHEREAS, as a result of this application, on June 10, 2014 the City of Newark was awarded a grant in the amount of $150,000.00 from the Essex County Open Space Trust Fund Local Aid Program for the design and construction of the Newark Riverfront Park Segment 3, which the City of Newark will substantially complete by or before June 1, 2015. The County, at its discretion can extend this completion deadline; and
WHEREAS, on or about April 30, 2014 the Mayor executed a grant agreement with the Essex County Open Space Trust Fund in order to obtain the grant award with no City funds required;
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor, and/or his designees, the Director of the Department of Economic and Housing Development and Planning Director, are hereby authorized to submit an application to the Essex County Recreation and Open Space Trust Fund requesting grant funding in the amount of $150,000.00 from the 2014 Essex County Open Space Trust Fund Local Aid Program to design and construct the Newark Riverfront Park Segment 3 with no City funds required (a copy of the application is attached hereto and made a part hereof).
- The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
- The grant award in the amount of $150,000.00 from the 2014 Essex County Open Space Trust Fund Local Aid Program is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

- The Mayor is hereby ratified and authorized to enter into and execute grant documents with the Essex County Recreation and Open Space Trust Fund to receive and expend the grant award in the amount of $150,000.00 to design and construct the Newark Riverfront Park Segment 3, which the City of Newark will substantially complete by or before June 1, 2015. The County, at its discretion can extend this completion deadline (a copy of the Agreement is attached hereto and made a part hereof).
- The agreement between the City of Newark and the Essex County Recreation and Open Space Trust Fund is hereby ratified from April 30, 2014 to the date of adoption of this authorizing resolution.

- No municipal funds are required for receipt or acceptance of this grant award.
- The Director of the Department of Economic and Housing Development shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement in the Office of City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designees, the Director of the Department of Economic and Housing Development and the Planning Director, to submit an application for grant funding in the amount of $150,000.00 from the 2014 Essex County Open Space Trust Fund Local Aid Program to design and develop Newark Riverfront Park Segment 3. This resolution further ratifies and authorizes the Mayor to accept the grant and enter into a grant agreement. No municipal funds are required.
