WHEREAS, pursuant to Resolution 7R1A(S), authorized on January 11, 2011, the City of Newark appropriated $100,000.00 in Community Development Block Grant (CDBG) funds to The North Ward Center, Inc., (hereinafter referred to as the Sub-recipient) to provide physical rehabilitation services to its facility located at 346 Mount Prospect Avenue, Newark, NJ 07104; and
WHEREAS, pursuant to Resolution 7R1-J, authorized on May 18, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute contract with the sub-recipient for the purpose of performing physical rehabilitation, for the contract period January 1, 2011 - December 31, 2011, in an amount not to exceed $100,000.00; and
WHEREAS, the Sub-recipient has requested authorization to extend the contract period to complete this project from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012; and
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in contract authorized under Resolution 7R1-J051811 shall remain in full effect.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Agreement, in the form attached hereto, with The North Ward Center, Inc., (hereafter referred to as the Sub-recipient) which will amend the term of the contract from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012, to allow the sub-recipient to complete the project.
2. The First Amended Agreement between the City of Newark and the sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
3. This resolution and a fully executed copy of the First Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
4. This project does not require the use of additional funds and all other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R1-J051811 shall remain in full effect and in accordance with the law.
