WHEREAS, the Federal Highway Administration (FHWA), Federal Aid Program, administered by the State of New Jersey Department of Transportation (NJDOT), for the 2022 Safe Routes to School Program (the “SRTS Program”), provides grant funding for improvements that enable and encourage walking and bicycling to school; and
WHEREAS, the City of Newark (the “City”) has a need for said grant funding to improve various streets and sidewalks at various schools throughout the City of Newark; and
WHEREAS, the City desires to further the public interest by obtaining FHWA funding from the 2022 SRTS Program; and
WHEREAS, on or about October 14, 2021, on behalf of the City, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $1,621,000.00 from the 2022 SRTS Program to construct bicycle and pedestrian improvements at various elementary schools with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City is required to submit a resolution from the Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel, the Business Administrator and the City Clerk for review, approval and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application to the NJDOT, requesting grant funding in the amount of $1,621,000.00 from the 2022 SRTS Program, with no City funds required (a copy of the application is attached hereto and made a part hereof including a map of school locations for the construction of bicycle and pedestrian improvements).
2. The Municipal Council hereby ratifies its authorization of this application from the date of the application submission to the date of adoption of this authorizing resolution.
3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted in the amount applied for and/or any increase or decrease thereto.
4. Upon notification of the receipt of a grant award in connection with this application, the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with NJDOT for the 2022 SRTS Program, to receive and expend the grant award to construct bicycle and pedestrian improvements at various elementary schools.
5. Upon notification of receipt of grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the Corporation Counsel and the Business Administrator for review, approval, and signature.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to: (1) submit an electronic grant application for; and (2) accept, enter into and execute an agreement for grant funding in the amount of $1,621,000.00 from the NJDOT’s 2022 SRTS Program, to construct bicycle and pedestrian improvements at various elementary schools. No municipal funds are required.
