ORDINANCE AUTHORIZING THE CITY OF NEWARK POLICE DEPARTMENT TO ENTER INTO A LEASE AGREEMENT WITH FLEET SUB MASTER TENANT, LLC., LANDLORD, TO LEASE A PORTION OF THE PREMISES COMMONLY KNOWN AS 189-191 MARKET STREET (BLOCK 146, LOT 40), FOR THE TERM OF THREE YEARS COMMENCING ON SEPTEMBER 1, 2015 AND TERMINTAING ON AUGUST 31, 2018 FOR THE SUM OF $3.00 ($1.00 PER YEAR), FOR USE AS A POLICE SUBSTATION MINI PRECINCT.

WHEREAS, the City of Newark Police Department, a non-profit corporation of the State of New Jersey, has tax exempt status with respect to the State of New Jersey and the federal government; and
WHEREAS, Fleet Sub Master Tenant, LLC owns the premises commonly known as 189-191 Market Street, Block 146, Lot 40, on the Official Tax Map of the City of Newark; and
WHEREAS, the City of Newark Police Department wishes to enter into a Lease Agreement with Fleet Sub Master Tenant, LLC, to lease a portion of the premises located at 189-191 Market Street (Block 146, Lot 40) for a period commencing on September 1, 2015 and terminating on August 31, 2018, for the sum of $3.00 ($1.00 per year), for use as a police substation mini-precinct.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark hereby authorizes the Lease Agreement with Fleet Sub Master Tenant, LLC to lease a portion of the premises commonly known as 189-191 Market Street, Block 146, Lot 40, for a period commencing on September 1, 2015 and terminating on August 31, 2018, for the sum of $3.00 ($1.00 per year), for use as a police substation mini-precinct.
2. The Mayor and/or his designee, the Director of the City of Newark Police Department, are hereby authorized to enter into the Lease Agreement, in the form attached hereto, on behalf of the City of Newark, with Fleet Sub Master Tenant, LLC., to lease a portion the premises commonly known as 189-191 Market Street, Block 146, Lot 40, pursuant to N.J.S.A. 40:60-25.51 for a period commencing on September 1, 2015 and terminating on August 31, 2018, for use as a police substation mini-precinct.
3. Both, the Landlord, Fleet Sub Master Tenant, LLC, and the Tenant, the City of Newark Police Department, shall be responsible for the enforcement and compliance of the covenants and conditions of the Lease Agreement.
4. Attached hereto is Certification of Funds from the Acting Director of Finance which states that there are available, legally appropriated funds for the purpose set forth hereinabove.
5. A copy of the Lease Agreement is attached hereto.
6. A copy of the fully executed Lease Agreement and this Ordinance shall be permanently filed in the Office of the City Clerk by the Director of the Police Department.
7. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This Ordinance authorizes a Lease Agreement between Fleet Sub Master Tenant, LLC, Landlord, and the City of Newark Police Department, Tenant, to lease a portion of the premises commonly known as 189-191 Market Street, Block 146, Lot 40, pursuant to N.J.S.A. 40:60-25.51 for a period commencing on September 1, 2015 and terminating on August 31, 2018, for use as a police substation mini-precinct, for the sum of $3.00 ($1.00 per year).
