WHEREAS, WellCare of New Jersey, soon to be known as Fidelis Care, (hereinafter “WellCare”) located at 550 Broad Street, 12th Floor, Newark, New Jersey 07102, wishes to provide funds to defray the cost and provide a gift sponsorship to the City of Newark’s Department of Health and Community Wellness in support of National Health Centers Week; and
WHEREAS, WellCare of New Jersey, a volunteer network, wishes to donate to the City of Newark (the “City”), Department of Health and Community Wellness (“DHCW”), approximately Seven Hundred Fifty Dollars and Zero Cents ($750.00), in support of National Health Center Week; and
WHEREAS, pursuant to Local Public Contracts Law N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use, which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, WellCare of New Jersey is donating $750.00 to defray cost and provide sponsorship for National Health Centers Week, at no cost to the City (see Gift Letter attached hereto); and
WHEREAS, WellCare of New Jersey fully understands and agrees it is not entitled to receive any direct benefit from the City in exchange for its gift; and
WHEREAS, pursuant to N.J.S.A. 40A: 5-29, the DCHW desires to accept the gift of $750.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept the gift from WellCare of New Jersey, soon to be known as Fidelis Care, located at 550 Broad Street, 12th Floor, Newark, New Jersey 07102, of Seven Hundred Fifty Dollars and Zero Cents ($750.00) to defray cost and provide sponsorship for National Health Centers Week to the Department of Health and Community Wellness.
2. No municipal funds shall be expended for the acceptance of this gift.
3. The Director of Health and Community Wellness shall file a copy of the gift letter in the Office of the City Clerk.
4. The acceptance of the gift is ratified from on or about July 27, 2023, to the date of adoption of this authorizing Resolution.
STATEMENT
This resolution ratifies and authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept the gift of Seven Hundred Fifty Dollars and Zero Cents ($750.00) to defray cost and provide sponsorship for National Health Centers Week from WellCare of New Jersey, 550 Broad Street, 12th Floor, Newark, New Jersey 07102, to sponsor the Department of Health and Community Wellness, in support of National Health Centers Week. This gift is at no cost to the City of Newark.
