WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, advertised for the receipt of bids on March 7, 2013, for Contract No. 12-2012, Various Streets (10 Locations) MA-2012 Newark Project; and
WHEREAS, on March 27, 2013, six (6) bids were received for Contract No. 12-2012, Various Streets (10 Locations) MA-2012 Newark Project, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
      WHEREAS, a public bidding process, in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., is a Fair and Open Process in accordance with the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44-20.5; and
      WHEREAS, based on a review of the bids, the Director of the Department of Engineering recommends acceptance of the Bid Proposal submitted by the lowest responsible bidder, Granada Construction Corp., 147 Thomas Street, Newark, New Jersey 07114 and seeks authority to execute Contract No. 12-2012, Various Streets (10 Locations) MA-2012 Newark Project, for an amount not to exceed $2,035,646.59.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to enter into and execute Contract No. 12-2012, Various Streets     (10 Locations) - MA-2012 Newark Project with the lowest responsible bidder, Granada Construction Corp., 147 Thomas Street, Newark, New Jersey 07114 , for an amount not to exceed $2,035,646.59.
    2. Attached hereto are Partial Certifications of Funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $1,784,342.39 for the purpose set forth hereinabove.  A copy of the Certifications of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
    3. The Director of the Department of Engineering is further authorized to extend this contract to its full value of $2,035,646.59, when the balance of the funds in the amount of $251,304.20 becomes available.  A copy of the additional Certification of Funds shall be filed with the Office of the City Clerk by the Director of Engineering.
    4. No amendments or modifications to the contract awarded shall be permitted without prior Municipal Council approval.
    5. A fully executed copy of the contract and Notice to Proceed shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.

7.      This contract is to be completed within a period of Three Hundred and Sixty-Five (365) consecutive calendar days from issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
  1. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., constitutes a Fair and Open Process pursuant to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq. and is in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.
  2. As the contract amount exceeds $2,000,000.00, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the Bid Proposal submitted by the lowest responsible bidder, Granada Construction Corp., 147 Thomas Street, Newark, New Jersey 07114, and enter into and execute Contract No. 12-2012, Various Streets (10 Locations) MA-2012 Newark Project, for an amount not to exceed $2,035,646.59, for a period of three hundred and sixty-five (365) consecutive calendar days from issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
