Original Resolution 7R12-a(AS) adopted on September 5, 2019 awarded a contract in an amount not to exceed $1,948,168.78, for a period of sixty (60) calendar days for base bid items and (120) calendar days for supplemental bid items, from the date of the issuance of a written Notice to Proceed.
Resolution 7R12-b adopted on October 7, 2020 - Change Order #1 extended the completion time to (535) calendar days from the date of the issuance of a written Notice to Proceed, with an end date of December 4, 2020.
Resolution 7R12-b adopted on June 2, 2021 - Change Order #2 extended the completion time to (715) days from the date of the issuance of a written Notice to Proceed, with an end date of August 27, 2021.
Resolution 7R12-a adopted on December 1, 2021 - Change Order #3 changed contract specifications at no extra cost and no change in the contract time period.
Change Order #4 will reduce the contract amount by $0.53 for a new total contract amount not to exceed $1,948,168.25 and extended the completion time to (450) days from the date of the issuance of a written Notice to Proceed, with an end date of November 19, 2022.

WHEREAS, Resolution 7R12-a (as) adopted on September 5, 2019, authorized the award of Contract 18-WS2018 to Millennium Communications Group, Inc., 11 Melanie Lane, Unit 13, East Hanover, New Jersey 07936, in the amount of $1,948,168.78 in accordance with the Local Public Contracts Law, N.J.S.A. 40A: 11-1 et seq.; for a period of sixty (60) calendar days for base bid items and one hundred twenty (120) calendar days for supplemental bid items, from the date of the issuance of a written Notice to Proceed; and
WHEREAS, Change Order #1, by Resolution 7R12-b adopted on October 7, 2020 extended the completion of the contract to five hundred thirty-five (535) calendar days from the date of the issuance of a written Notice to Proceed; and
WHEREAS, Change Order #2, by Resolution 7R12-b adopted on June 2, 2021 extended the completion of the contract to Seven Hundred fifteen (715) calendar days from the date of the issuance of a written Notice to Proceed; and
WHEREAS, Change Order #3, by Resolution 7R12-b adopted on December 1, 2021 made changes to the contract specifications with no change in the contract amount, and no change in the contract completion time; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Change Order #4 to Contract 18-WS2018 Pequannock Watershed Dams/Reservoir Security Improvements - Phase 1, with Millennium Communications Group, Inc., with a reduction in the contract amount by $0.53 for a total contract amount of $1,948,168.25 and extending the contract completion time by 450 calendar days to final completion from the date of the issuance of a written Notice to Proceed.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Contract Change Order #4 to 18-WS2018 Pequannock Watershed Dams/Reservoir Security Improvements - Phase 1 with Millennium Communications Group, Inc., 11 Melanie Lane, Unit 13, East Hanover, New Jersey 07936, reducing the contract amount by $0.53 bringing the final contract amount to $1,948,168.25, and extending the contract completion time by (450) calendar days for completion from the date of the issuance of a written Notice to Proceed.
2. Funds for this contract previously certified and encumbered in support of Resolution 7R12-f (AS) adopted on December 29, 2020 remain available from the Water Capital Account, until completion and close-out of the contract.
3. This Change Order is ratified from the date of the Contract Modification Proposal and Acceptance Change Order# 4 to the date of this authorizing Resolution.
4. A fully executed copy of the Change Order #4 shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities.
5. A fully executed copy of the Change Order #4 shall be filed with the New Jersey Department of Environmental Protection by the Director of the Department of Water and Sewer Utilities.
6. If required by State Law, the Acting City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution ratifies, amends and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Contract Change Order #4 to Contract 18-WS2018 Pequannock Watershed Dams/Reservoir Security Improvements - Phase 1 with Millennium Communications Group, Inc., reducing the contract amount by $0.53 for a total contract amount of $1,948,168.25, and extending the contract completion time by (450) calendar days from the issuance of a Notice to Proceed.
