WHEREAS, the Municipal Council adopted Resolution 7R8-c(S) on December 21, 2021, authorizing a Hold Harmless and Indemnification Agreement for the Annual Newark Three Kings Children’s Celebration at the New Jersey Institute of Technology, 104 Lock Street, Newark, New Jersey 07103, on Thursday, January 6, 2022, from 3:30 P.M. until 7:30 P.M. (Includes Set-up time at 8:00 A.M. and Clean-up/Breakdown ending at 9:00 P.M); but due to the closure of Newark Public Schools, amid a spike in new COVID-19 cases and the emergence of the Omicron variant there is a need to reschedule the event; and
WHEREAS, the Municipal Council desires to support the Annual Newark Three Kings Children’s Celebration at Barringer High School (Outside and around premises), 90 Parker Street, Newark, New Jersey 07104, on Saturday, January 15, 2022, from 3:00 P.M. until 7:00 P.M.; and
WHEREAS, the Municipal Council has indicated its’ support for this wholesome event that will benefit Newark residents, by supporting the issuance of a Hold Harmless and Indemnification Agreement by the City of Newark, Insurance Fund Commission, for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council wishes to amend Resolution 7R8-c(S) adopted on December 21, 2021 and reschedule the date and location of the Annual Newark Three Kings Children’s Celebration from Thursday, January 6, 2022 to Saturday, January 15, 2022 to be held at Barringer High School (Outside and around premises), 90 Parker Street, Newark, New Jersey 07104, from 3:00 P.M. until 7:00 P.M.
2. The Municipal Council supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark, Insurance Fund Commission, for the benefit of the Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City of Newark’s use of Barringer High School (Outside and around premises), 90 Parker Street, Newark, New Jersey 07104, for the Annual Newark Three Kings Children’s Celebration on Saturday, January 15, 2022, from 3:00 P.M. until 7:00 P.M.
2. The City Clerk, on behalf of the Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for their records.
3. A copy of the executed Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission shall be filed in the Office of the City Clerk.
STATEMENT
This Resolution amends Resolution 7R8-c(S) adopted on December 21, 2021 to reschedule the date and location of the Annual Newark Three Kings Children’s Celebration; furthermore, the Municipal Council supports the issuance, by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City of Newark’s use of Barringer High School (Outside and around premises), 90 Parker Street, Newark, New Jersey 07104, for the Annual Newark Three Kings Children’s Celebration, to be held on Saturday, January 15, 2022, from 3:00 P.M. until 7:00 P.M., sponsored by Council President, Luis A. Quintana.
