WHEREAS,  On March 1, 2016, the City of Newark, through its Supervising Procurement Specialist, advertised to solicit bids for contractors to provide the Rental of Refuse Equipment Rear Loader Packer Vehicle (25 or 32) Plus  Driver to the Department of Public Works, as per the bid proposal attached hereto; and

 

WHEREAS, the Division of Central Purchasing distributed eight (8) bid proposal packages to prospective vendors following the date of advertisement; and

 

WHEREAS, on March 17, 2016, two (2) bids were received in response to this advertisement; and

 

WHEREAS, the Director of the Department of Public Works reviewed the bids and recommended that the contract for the Rental of Refuse Equipment Rear Loader Packer Vehicle (25 or 32) Yards Plus Driver be awarded to the lowest responsive and responsible bidder, T. Farese & Sons Inc., dba Direct Waste Services; and                                                                 

 

 WHEREAS, pursuant to N.J.S.A. 40A:11-24, the vendor consented to hold the prices bid until such time as an award is made; and 

 

WHEREAS, pursuant to N.J.S.A. 19:44A- 20.5, et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1, et seq., meet the requirements of the fair open process.    

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Supervising Procurement Specialist, are authorized  to execute and enter into a contract with T. Farese  & Sons Inc., dba Direct Waste Services, 217 Poinier Street, New Jersey 07114,  for the City of Newark’s Rental of Refuse Equipment Rear Loader Packer Vehicle  (25 or 32) Yards Plus  Driver, as said vendor was determined be the lowest responsive and

responsible bidder in accordance with bid specifications and its bid was received on the advertised due date. Pursuant to N.J.S.A. 40A:11-3(b), the term of the contract shall be established for a term of two (2) years.

 

2.                     There shall be no amendments or changes to this contract without the     approval of the Municipal Council.

 

3.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Pursuant to N.J.A.C. 5:30-5.5(d)2, funds for 2016 and subsequent years are contingent upon appropriations.                     

 

4.                     This is an open ended contract to be used as needed during the term of the contract.  Thus, as required by N.J.A.C. 5:30-5.5(d)(2), for any and all expenditures against this contract, each time an order is placed, a certification of the availability of funds sufficient to cover the amount of the services ordered shall be executed before contractual liability is incurred for account code lines NW011, Dept. 160, Divisions 1604, 1605, 1606 and 1607, Accounts 71280 and 71280-B2016- Department of Public Works. This contract shall not exceed the total of Three Hundred Twenty Five Thousand Dollars and Zero Cents ($325,000.00) for the two (2) year term.

 

5.                     The Supervising Procurement Specialist shall forthwith file a duly executed copy of the contract in the Office of the City Clerk.

 

6.                     If required by state law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This resolution authorizes the Mayor and /or his designee, the Supervising Procurement Specialist, to enter into a two (2) year contract with F. Farese & Sons Inc., dba Direct Waste Services for the Rental of Refuse Equipment Rear Loader Packer Vehicle (25 or 32) Yards Plus Driver by the City of Newark, at a cost not to exceed  Three Hundred and Twenty Five Thousand Dollars and Zero Cents ($325,000.00)  for the two (2) year term.
