WHEREAS, the State of New Jersey by and for the Department of Environmental Protection, Division of Watershed Protection and Restoration, Bureau of NJDES Stormwater Permitting and Water Quality Management (“Granting Agency”) received federal funds (American Rescue Plan Act - Coronavirus State Fiscal Recovery Fund “CSFRF” monies) to provide funding to NJDEP for the implementation of NJDEP’s Stormwater Management Grants that the Governor’s Disaster Recovery Office has determined eligible for CSFRF funds; and

WHEREAS, the City of Newark, Department of Water and Sewer Utilities (“the Department”) is requesting funding for implementation of stormwater utility, which includes development of stormwater rate ordinance, credits and appeals program, stormwater data management tool, billing system, web portal, stormwater utility business process, and overall project implementation; and

WHEREAS, on September 13, 2022, on behalf of the City of Newark, the Director of Department of Water and Sewer Utilities submitted an application to Granting Agency requesting grant funding in the amount of $150,000.00 from the Stormwater Utility Implementation Grant for the implementation of stormwater utility, which includes development of stormwater rate ordinance, credits and appeals program, stormwater data management tool, billing system, web portal, stormwater utility business process, and overall project implementation; and

WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of $150,000.00 from the Granting Agency for implementation of stormwater utility, which includes development of stormwater rate ordinance, credits and appeals program, stormwater data management tool, billing system, web portal, stormwater utility business process, and overall project implementation (Stormwater Grant Identifier SWM-2022-Newark-00087) for the period commencing upon adoption by the Municipal Council of this authorizing resolution and continuing for 16 months thereafter, or as otherwise authorized by NJ DEP; and

WHEREAS, the City must execute a grant agreement with Granting Agency in order to obtain the grant award with $143,000.00 of City funds required.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                      The Mayor and/or his designee, the Director of Department of Water and Sewer Utilities, are hereby authorized to submit an application to State of New Jersey by and for the Department of Environmental Protection, Division of Watershed Protection and Restoration, Bureau of NJDES Stormwater Permitting and Water Quality Management requesting grant funding in the amount of $150,000.00 from the Stormwater Utility Implementation Grant for the implementation of stormwater utility, which includes development of stormwater rate ordinance, credits and appeals program, stormwater data management tool, billing system, web portal, stormwater utility business process, and overall project implementation (Stormwater Grant Identifier SWM-2022-Newark-00087) with $1430,000.00 of City funds required (a copy of the application is attached hereto and made a part hereof).

2.                      The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3.                      The grant award in the amount of $150,000.00 from the State of New Jersey by and for the Department of Environmental Protection, Division of Watershed Protection and Restoration, Bureau of NJDES Stormwater Permitting and Water Quality Management is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

4.                      The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are hereby authorized to enter into and execute grant documents with the State of New Jersey to receive and expend the grant award in the amount of $150,000.00 for the implementation of stormwater utility, which includes development of stormwater rate ordinance, credits and appeals program, stormwater data management tool, billing system, web portal, stormwater utility business process, and overall project implementation for the period commencing upon adoption by the Municipal Council of this authorizing resolution and continuing for 16 months thereafter, or as otherwise authorized by NJ DEP (a copy of the Agreement is attached hereto and made a part hereof).

5.                      Matching funds in the amount of $143,000.00 shall be provided from the following line appropriation of the official municipal budget: Business Unit 038; Department 800; Division 8003; Account 71240, Budget 2024.

6.                      The Director of the Department of Water and Sewer Utilities shall file a fully executed copy of the grant application, the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.

STATEMENT

This resolution ratifies and authorizes the actions taken by the Director of the Department of Water and Sewer Utilities to submit an application for grant funding from the State of New Jersey by and for the Department of Environmental Protection, Division of Watershed Protection and Restoration, Bureau of NJDES Stormwater Permitting and Water Quality Management (NJDEP) for the implementation of stormwater utility, and furthermore, ratifies and authorizes Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute an agreement with and accept the grant funds in the amount of $150,000.00 from NJDEP for the period commencing upon adoption by the Municipal Council of this authorizing resolution and continuing for 16 months thereafter, or as otherwise authorized by NJ DEP. Matching grant funds in the amount of $143,000.00 shall be provided from the 2024 municipal budget.
