This resolution authorizes the use of Competitive Contracting for the procurement of a Career Service Provider under guidelines of the Workforce Innovation and Opportunity Act (WIOA).

WHEREAS, pursuant to the Workforce Innovation and Opportunity Act (“WIOA”) , local workforce development areas provide funding, guidance and alignment of public workforce development systems to equip workers with the skills necessary to meet business needs and to support businesses with access to talent pools needed to compete in their local, regional and global economies; and
WHEREAS, the WIOA assigns responsibilities at the federal, state and local levels for the creation and maintenance of a One Stop delivery system and establishes a number of required partners among education, business, labor, economic development, public agencies, and community- based organizations; and
WHEREAS, the Newark Workforce Development Board conducts oversight of the One Stop Career Center in Newark, which serves as the primary access point for workforce development services, providing a range of services including job search assistance, career counseling, training programs, and support services; and
WHEREAS, the City of Newark together with the Newark Workforce Development Board is seeking a Career Service Provider, to manage and deliver the services for the daily operations of the Newark One Stop Career Center (NOSCC); and
WHEREAS, accordingly the City desires to use a third-party provider to serve as the Career Service Provider to operate, manage, and administer the services through the Newark One Stop Career Center (NOSCC); and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) authorizes the use of competitive contracting in lieu of public bidding for the procurement of specialized goods and services for the purpose of operation, management, and administration of a Social Service Program such as the One Stop Career Center; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Governing Body shall pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and
WHEREAS, the competitive contracting process shall be administered by the Qualified Purchasing Agent, in consultation with the Newark Workforce Development Board, pursuant to N.J.S.A.40A:11-4.3(b), and any contract awarded under this process shall be made by resolution of the Newark Municipal Council.
NOW, THEREFORE, BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Newark Municipal Council hereby authorizes the Business Administrator and the Qualified Purchasing agent to use competitive contracting pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure a Career Service Provider, to operate, manage, and administer the social service program provided through the One Stop Career Center, as required by the Workforce Innovation and Opportunity Act and as determined by the Newark Workforce Development Board and Mayor’s Office of Employment and Training
2. The competitive contracting process shall be administered by the Qualified Purchasing Agent of the City of Newark, legal counsel, or the administrator of the contracting unit, pursuant to N.J.S.A. 40A:11-4.3(b).
3. Any contract awarded under the competitive contracting process shall be made by resolution of the Municipal Council, subject to the provisions of N.J.S.A. 40A:11-4.5.
