WHEREAS, the City of Newark seeks to achieve measurable progress in reducing waste at the neighborhood level and diverting waste for productive purposes which may include organic waste processing, recycling initiatives and responsible disposal of hazardous materials; and
 
WHEREAS, through Resolution 7R3-e adopted on January 6, 2010, the Municipal Council authorized the Department of Economic and Housing Development to apply for and accept grant funding from the U.S. Department of Energy ("DOE") Energy Efficiency and Conservation Block Grant ("EECBG") program as a part of the American Recovery Reinvestment Act of 2009 (ARRA) in the amount of $2,836,300.00 for activities including sub-grants to community organizations for Green Neighborhood Pilot projects for which purpose up to $567,000.00 in EECBG funds may be allocated; and
 
WHEREAS, through a competitive bidding process the City advertised a Request for Proposals for Newark-based non-profit organizations to support the creation of a Green Neighborhood Pilot Program focused on Waste Diversion, and of the six (6) qualified respondents, Ironbound Community Corporation, ICC, located at 179 Van Buren Street, Newark, NJ 07105, submitted the proposal considered by a review committee to be the one of the best and most responsive, taking into account a combination of factors including price, experience, success with community engagement, and staff qualifications; and
 
WHEREAS, Ironbound Community Corporation will develop a Waste Diversion Program targeting the East Ferry Street neighborhood to promote recycling and reuse, outreach and education, green business forums on waste diversion, and pilot composting projects, the cost of all of which shall not exceed $126,196.00; and
 
WHEREAS, this Grant Agreement is being awarded in accordance with the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, the Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and is in compliance with the Newark Executive Order MEO-07-0001, effective March 31, 2007 and also with the provisions of the American Reinvestment Recovery Act of 2009, Public Law 111-5 (ARRA). All activities funded under this contract must comply with the rules and regulations of ARRA, including, as applicable, Buy American Act, 41 U.S.C. §§ 10(a) - 10(d) Davis-Bacon Act, 40 U.S.C. §3141, the National Environmental Policy Act (NEPA), 42 U.S.C. §4321 and Waste Stream rules and regulations; and
 
WHEREAS this project will be supported exclusively from grant funds accepted by the City through Resolution 7R3-e adopted on January 6, 2010; and
 
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.  
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Deputy Mayor/Director of Economic and Housing Development, are hereby authorized to enter into and execute the attached Grant Agreement with the Ironbound Community Corporation, located at 179 Van Buren Street, Newark, NJ 07105, in an amount not to exceed $126,196.00, to develop a Waste Diversion Program as specified in the attached Scope of Services in the East Ferry Street neighborhood of the City of Newark using EECBG funds from the U.S. Department of Energy.
    2. The Grant Agreement shall be for a period commencing on the date of approval of this Resolution by the Municipal Council and terminating eight months thereafter or August 15, 2012, whichever comes first.
    1.     1. The Deputy Mayor/Director of Economic and Housing Development shall file a fully-executed copy of the Grant Agreement with Ironbound Community Corporation, the grant application, the grant award letter, and copy of the certification of funds in the Office of the City Clerk.
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Deputy Mayor/ Director of Economic and Housing Development, to enter into and execute a Grant Agreement with the Ironbound Community Corporation located at 179 Van Buren Street, Newark, NJ 07105, in an amount not to exceed $126,196.00 in EECBG funds from the U.S. Department of Energy, to develop a Waste Diversion Program in the East Ferry Street neighborhood, in the City of Newark for a period commencing on the date of approval of this Resolution by the Municipal Council and terminating eight months thereafter or August 15, 2012, whichever is the earlier.  This project will be funded exclusively from previously accepted Energy Efficiency and Conservation Block Grant funds.
