WHEREAS, the New Jersey Recreation & Park Association, 1 Wheeler Way, Princeton NJ 08540-5915 (“NJRPA”), the New Jersey Swim Safety Alliance (“NJSSA”), and Dolfin Swim Wear (“DSW”) would like to donate one hundred (100) swimsuits and forty-eight (48) pairs of goggles to the City of Newark, thereby enabling children who do not have acceptable bathing attire to participate in aquatic sports; and

 

WHEREAS, said swimsuits and goggles have a value of approximately One Thousand Eight Hundred Dollars and Zero Cents ($1,800.00); and

 

WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services (“Department”) desires to accept the gift and to acknowledge the donation; and

 

WHEREAS, NJRPA, the NJSSA and DSW fully understand and agree that they are not entitled to receive any direct benefit from the City of Newark, Mayor Ras J. Baraka, or any other personnel affiliated with the City of Newark in exchange for the gift; and 

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize same in the manner set forth in the conditions of the bequest, legacy or gift; provided, however, that such bequest, legacy, or gift shall not be used in a manner which is inconsistent with the laws of the State of New Jersey or the laws of the United States of America.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from New Jersey Recreation & Park Association, 1 Wheeler Way, Princeton NJ 08540-5915 of one hundred (100) swimsuits and forty-eight (48) pairs of goggles in order to make swimming accessible to Newark children who would love to participate in the aquatic programs, but often do not have the acceptable bathing attire for participation.   

 

2.                     This gift of one hundred swimsuits and forty-eight pairs of goggles is valued at approximately One Thousand Eight Hundred Dollars and Zero Cents ($1,800.00).

 

3.                     The City acknowledges this generous donation through this resolution. 

 

4.                     No municipal funds will be expended for the acceptance of this gift.

 

 

STATEMENT

 

This Resolution authorizes the Mayor and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services to accept the gift from the New Jersey Recreation & Park Association, 1 Wheeler Way, Princeton NJ 08540-5915, the New Jersey Swim Safety Alliance, and Dolfin Swim Wear of 100 swimsuits and 48 pairs of goggles to the City of Newark to make swimming assessable to Newark children. The gift of the swimsuits and goggles is valued at approximately $1,800.00. No municipal funds will be expended for the acceptance of this gift.
