WHEREAS, the City of Newark (the “City”) has a need to provide Animal Shelter Management Services for its injured, trapped and sick animals and animals whose lives are endangered or animals that are a danger to human beings; and

                     

                     WHEREAS, the City desires to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the citizens of the City of Newark pursuant to N.J.S.A. 40:48-2; and

                     

 WHEREAS, pursuant to N.J.S.A. 40:48-5.1 the City desires to enter into a contract for the period of January 1, 2020 through December 31, 2024, in an amount not to exceed Six Million, Nine Hundred Fifty-Five Thousand Four Hundred Seventy-Six Dollars and Zero Cent ($6,955,476.00); and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.5 et seq., this contract is subject to the availability and appropriation of sufficient funds annually; and

 

WHEREAS, this contract shall be awarded as an open-ended contract and shall not exceed Six Million, Nine Hundred Fifty-Five Thousand Four Hundred Seventy-Six Dollars and Zero Cent ($6,955,476) for five (5) years.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, is hereby authorized to enter into and execute a contract with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the contract period of January 1, 2020 through December 31, 2024, in an amount not to exceed Six Million Nine Hundred Fifty-Five Thousand Four Hundred Seventy-Six Dollars and Zero Cent ($6,955,476.00) for provision of animal sheltering and impoundment services in the City of Newark.

 

2.                     This contract shall be ratified back to  January 1, 2020, to the date of adoption of this resolution.

 

3.                     The contract is awarded as an open-end contract pursuant to N.J.A.C. 5:30-5.5(b)(2). A Certification of Funds shall be executed each time services are used and charged against this contract.

 

4.                     Pursuant to N.J.A.C. 5:30-5.5 et seq., this contract is subject to the availability and appropriations of sufficient funds annually.

 

5.                     Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Health and Community Wellness, shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Health and Community Wellness beyond the extent to which monies are available.

 

6.                     Attached hereto is a partial Certification of Funds issued by the Chief Finance Officer, which states partial funds in the amount of $345,100.00 is available in the 2020 Temporary Budget Line Items: NW011-120-1203-95920-B2020 ($127,100.00) and NW011-200-2001-95920-B2020 ($218,000.00). The Certification shall be filed, along with the original resolution and the executed contract, in the Office of the City Clerk.

 

7.                     A copy of the executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.

 

8.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of  Health and Community Wellness, to enter into and execute an open-ended contract with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the period of January 1, 2020 through December 31, 2024, in an  amount not to exceed Six Million Nine Hundred Fifty-Five Thousand Four Hundred Seventy-Six Dollars and Zero Cent ($6,955,476.00) for the provision of animal sheltering and impoundment services in the City of Newark.
