WHEREAS, the City of Newark (the “City”) wishes to provide Emergency Medical Services to its citizens and visitors of the City; and

 

WHEREAS, University Hospital /UH-EMS is a State-controlled entity of the State of New Jersey, which provides complete Emergency Medical Services, including E-911 medical dispatch, basic life support, advanced life support and heavy rescue; and

 

WHEREAS, the City and UH-EMS wishes to enter into and execute a contract for these Emergency Medical Services; and

 

WHEREAS, this is a no bid contract, awarded without competitive bidding, as an exception to the Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), the contract between the City and UH-EMS, an agency of the State of New Jersey, is not subject to the Pay-to-Play legislation.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Public Safety, Fire Division, are hereby authorized to enter into and execute a contract with University Hospital/UH-EMS, 150 Bergen Street, Newark, New Jersey 07101, for Emergency Medical Services, for the period of January 1, 2023 through December 31, 2024, in an amount not to exceed Two Million and Two Hundred and Twenty-Five Thousand Dollars and Zero Cents ($2,225,000.00) for Calendar Year 2023 and Two Million Two Hundred and Twenty-Five Thousand Dollars ($2,225,000.00) for Calendar Year 2024.

 

2.                     The Municipal Council ratifies its authorization of this contract from January 1, 2023 to the date of adoption of this authorizing Resolution.

 

3.                     This contract is awarded without competitive bidding as an exception to the Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), in that the contract is between the City of Newark and University Hospital/UH-EMS, an agency of the State of New Jersey and is not subject to the Pay-to-Play legislation.

 

4.                     Pursuant to N.J.A.C. 5:30-5.5, attached is a partial certification of funds from the Director of Finance which states that funds in the amount of $2,225,000.00, from Bus. Unit NW011, Div./Proj. 2001, Account #96080, Budget 2023.  The remainder of the funding for this contract will be subject to appropriation in the 2023 and 2024 Budgets and said funds will be certified prior to services being provided by the contractor. There will be no expenditure of funds authorized until a Certification of Funds is obtained and a copy filed with the City Clerk.

 

5.                     If required by State Law, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller, no later than twenty (20) business days following such award in accordance with N.J.S.A. 52:15c and the Notice of the Office of the State Comptroller, dated May 7, 2008.

 

6.                     The Director of the Department of Public Safety, shall file a fully executed copy of the contract in the Office of the City Clerk.

 

7.                     There shall be no amendment or change to the contract without authorization of the Municipal Council.

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor and/or his designee, the Director of Public Safety, Fire Division, to enter into and execute a contract for Emergency Medical Services with University Hospital/UH-EMS, 150 Cabinet Street, Newark, New Jersey 07103, for the period of January 1, 2023 through December 31, 2024, in a total amount not to exceed $4,450,000.00.
