WHEREAS, pursuant to Resolution 7R9-b(S), adopted on September 27, 2016, the Municipal Council supported the issuance of a Hold Harmless and Indemnification Agreement for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark” at Edison Parking Corporation, 110 Edison Place 1st Floor, Newark, New Jersey 07102, on Friday, October 14, 2016 through Wednesday, October 26, 2016, between 6:00 P.M. and 10:00 P.M.; and
WHEREAS, it has been requested that the 4th Ironbound Multi-Cultural Festival be rescheduled to Friday, October 14, 2016 through Sunday, October 23, 2016, between 6:00 P.M. and 10:00 P.M, and to amend the Hold Harmless and Indemnification Agreement to reflect the Newark Warehouse Redevelopment Company, LLC. as the beneficiary.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R9-b(S), adopted on September 27, 2016, is hereby amended to reflect that the Municipal Council of the City of Newark supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission for the benefit of Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, Newark, New Jersey 07102 for any claims arising out of the City of Newark’s use of property owned by the Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, 1st Floor, Newark, New Jersey 07102 for the 4th Ironbound Multi-Cultural Festival - “Celebrate Newark,” sponsored by Councilman Augusto Amador, from Friday, October 14, 2016 through Sunday, October 23, 2016, and/or any re-scheduled Rain Date, between the hours of 6:00 P.M. until 10:00 P.M.
2. The City Clerk, on behalf of the Newark Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the Newark Warehouse Redevelopment Company, LLC, 110 Edison Place, Newark, New Jersey 07102 for their records.
3. A copy of the executed Hold Harmless and Indemnification Agreement, drawn by the Insurance Fund Commission, shall be filed in the Office of the City Clerk.
