Additional Information: 

An Emergency Contract, #E2026-04 for the period of March 06, 2026 through June 06, 2026, was awarded in an amount not to exceed $539,311.00 for the Department of Water and Sewer Utilities.

 

This current Resolution of Emergency Contract #E2026-04 will authorize and further extends the contract for an additional (90) days from June 07, 2026 through September 04, 2026, with no additional changes.

WHEREAS, the Department of Water and Sewer Utilities (“the Department”) is responsible for maintaining the City’s water supply infrastructure within the Pequannock Watershed; and

 

WHEREAS, on March 03, 2026 the Director of the Department requested a declaration of emergency as an inspection of the Charlotteburg Reservoir Dam noted an increased leakage has been observed within the ventilation shaft and through the downstream face of Monolith 10 to the right of the spillway. The increased leakage was reported by the City when the reservoir was around its normal pool (EL. 738) and was reported to stop when the reservoir was at approximately EL. 733. Leakage has also historically been observed through various other joints/cracks inside the dam. These conditions harm the city’s water system in the Pequannock Watershed, requiring immediate action to protect the health, safety, and welfare of the city’s residents and water customers, and to provide a safe and potable water source; and

 

WHEREAS, these conditions adversely affect the City's water system and require immediate corrective action to protect the health, safety and welfare of the residents of the City of Newark and its water customers and to ensure the continued provision of a safe and potable water supply; and

 

WHEREAS, on November 01, 2025, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1, the Qualified Purchasing Agent, QPA, approved the aforementioned request, and the City entered into Emergency Contract # E2026-04 with Hutton Construction, LLC. 41 Village Park Road, Cedar Grove, New Jersey 07009 and Colonnelli Brothers, Inc. 409 South River Street, Hackensack, New Jersey, 07601, to provide immediate dam repairs of leakage, wall and grout foundations at Charlotteburg Reservoir Dam for a total not-to-exceed contract amount of Five Hundred Thirty-Nine Thousand Three Hundred Eleven Dollars and Zero Cents ($539,311.00); and

 

WHEREAS, N.J.S.A. 40A:11-6 provides that Emergency Contacts may be entered into when an emergency affecting public health, safety or welfare requires the immediate delivery of goods or the performance of service; and

 

WHEREAS, the Department desires to extend Emergency Contract #E2026-04 for the period commencing June 07, 2026, through September 06, 2026, or until completion of the project, whichever is sooner; and

 

WHEREAS, in order for Colonnelli Brothers, Inc. to safely perform the required repairs, the reservoir water level must be maintained at approximately 772 feet; and

 

WHEREAS, due to excessive snowmelt and significant rainfall during the spring of 2026, the reservoir water level has remained above the required elevation necessary to commence the repair work, as documented by GZA GeoEnvironmental, Inc. in its correspondence dated May 12, 2026; and

 

WHEREAS, Colonnelli Brothers, Inc. is currently on hold while the City lowers the reservoir to the required operating elevation; and

 

WHEREAS, the City's Administration and the Director of the Department of Water and Sewer Utilities have determined that extending the emergency contract is necessary and in the best interests of the City; and

 

WHEREAS, Newark City Code §2:5-13.2e limits the period of emergency contracts to ninety (90) days and permits extensions only with the authorization of the Municipal Council.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     An extension of Emergency Contract #E2026-04 with Hutton Construction, LLC. 41 Village Park Road, Cedar Grove, New Jersey 07009 and Colonnelli Brothers, Inc. 409 South River Street, Hackensack, New Jersey, 07601, for emergency repairs to the ventilation shaft and downstream face of Monolith 10 to the right of the spillway at the Charlotteburg Reservoir Dam, is hereby authorized.

 

2.                     The extension is granted for the period commencing on June 07, 2026 and ending September 06, 2026.

 

3.                     This authorization of the emergency contract extension is hereby ratified back from June 07, 2026 to the date of adoption of this authorizing resolution.

 

4.                     The Qualified Purchasing Agent shall file a copy of this resolution and Emergency Contract #E2026-04 with the Office of the City Clerk and shall post a copy of the emergency contract and extension on the City of Newark’s website within forty-eight (48) hours.

 

5.                     If required by State law, the City Clerk shall provide the appropriate notice of the award and extension to the Office of the State Comptroller within twenty (20) business days in accordance with N.J.S.A. 52:15C-10.

This resolution ratifies and authorizes the extension of Emergency Contract #E2026-04 with Hutton Construction, LLC. 41 Village Park Road, Cedar Grove, New Jersey 07009 and Colonnelli Brothers, Inc. 409 South River Street, Hackensack, New Jersey, 07601, for the immediate dam repairs of leakage, wall and grout foundations at Charlotteburg Reservoir Dam. The extension is from June 07, 2026 through September 06, 2026, for a total not-to-exceed amount of Five Hundred Thirty-Nine Thousand Three Hundred Eleven Dollars and Zero Cents ($539,311.00), with no additional changes.
