WHEREAS, the State of New Jersey, Department of Law and Public Safety, Division of Highway Traffic Safety (DHTS), is responsible for the administration of Drunk Driving Enforcement Fund (DDEF), which was established pursuant to N.J.S.A. 39:4-50.8; and

WHEREAS, Municipalities, the Division of State Police, interstate law enforcement agencies and county law enforcement agencies may apply to the DHTS for DDEF funds for additional enforcement patrols, checkpoints, court proceedings and any appropriate measures pertaining to other drunk driving enforcement activities which are authorized by the DDEF administrative regulations, N.J.A.C. 13:86-1.1 et seq., and approved by the DHTS Director; and

WHEREAS, the City of Newark, has been awarded DDEF reimbursement funds in the amount of Ninety-one Thousand Two Hundred Twenty-Two Dollars and Forty-Nine Cents ($91,222.49) for the period commencing on January 1, 2026 until the funds are expended.


NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to receive reimbursement funding in the amount of Ninety-one Thousand Two Hundred Twenty-Two Dollars and Forty-Nine Cents ($91,222.49) from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety ("DHTS"), P.O. Box 048, Trenton, New Jersey 08625, 2026 Drunk Driving Enforcement Fund (DDEF) Program.

2. The Municipal Council hereby ratifies authorization of this acceptance back to February 5, 2026, the date of issuance of the award letter (a copy of the award letter is attached hereto and made a part hereof).

3. Reimbursement funds in the amount of Ninety-one Thousand Two Hundred Twenty-Two Dollars and Forty-Nine Cents ($91,222.49) from the DHTS are hereby accepted.

4. The Mayor and/or his designee, the Public Safety Director, and all other relevant city officials are hereby authorized to take all measures necessary to receive and to expend the reimbursement funds in accordance with DDEF regulations for the period commencing on January 1, 2026 and terminating at such time when the funds are expended.

5. No municipal funds are required for receipt or acceptance of this grant award.


STATEMENT

This resolution ratifies and authorizes the actions taken by the Public Safety Director to receive grant funds for the Drunk Driving Enforcement Fund from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, which funds are to be utilized for police initiatives to address drunk driving violations within the City of Newark for the period commencing on January 1, 2026, and terminating at such time when funds are expended.
